The Director of Public Safety (the “Director”) is hereby authorized to order the creation upon the public streets of the Town, of:
(1) 
Temporary no-parking zone(s); and
(2) 
Temporary resident-only permit parking zones.

Temporary no-parking zone(s) and temporary resident-only permit parking zones shall exist for a time period of no longer than one hundred and sixty-eight (168) hours.

The Director shall order the creation of said temporary no-parking zones and/or temporary resident-only permit parking zones only for the following purposes:
(1) 
To aid the public health, safety or welfare;
(2) 
To alleviate extraordinary and temporary problems in the movement of traffic and/or hindrances in the movement of authorized emergency vehicles;
(3) 
To facilitate public works or the maintenance, cleaning or care of public streets, and facilities;
(4) 
For Town-sponsored events; or
(5) 
In conjunction with any Town-authorized, temporary street closing.

The Director shall cause the temporary no-parking zone and/or the temporary resident-only permit parking zone to be adequately and clearly posted to inform the public of the parking zone.

For temporary no-parking zones, and during the time designated under any such order of the Director, it shall be unlawful for any person to park a motor vehicle or conveyance within such zone.

(a) 
Following the creation of a temporary resident-only permit parking zone(s), the director or his designee shall communicate and provide the residents within the designated zone the following information and documents:
(1) 
A "notice of designation" that shall inform the residents in the applicable zone of:
(A) 
The existence, along with the street block(s), and/or residential address(es) that comprise the temporary resident-only permit parking zone;
(B) 
The parking restrictions applicable to all vehicles in the designated zone that do not properly display a parking permit authorized under this division;
(C) 
The duration of the temporary resident-only permit parking zone; and
(2) 
Two (2) town-issued parking permits which indicate "temporary resident-only parking permit."
(b) 
Upon application, the town may also issue additional temporary resident-only parking permits, but only: (i) to the inhabitants of those residences within the temporary resident-only parking zone and no other; and (ii) for guests of the applicant during the specific resident-only permit parking time and no other.
(1) 
In an application for additional temporary resident-only parking permits, the applicant, in addition to demonstrating proof of residency in the temporary resident-only permit parking zone, shall provide the following information:
(A) 
The type and kind of event which applicant will host at applicant's residence during the specific resident-only permit parking time, and the anticipated number of guests that will attend the event;
(B) 
The number of additional temporary resident-only parking permits that applicant requests for the guests/attendees of the event in subsection (A) above; and
(C) 
The signature of the applicant.
(2) 
In accordance with section 12.07.143 above, the director may limit the number of additional temporary resident-only parking permits issued to applicants.
(c) 
Individuals receiving temporary resident-only parking permits pursuant to subsection (a)(2) and/or subsection (b) above are deemed to be lawful holders of a temporary resident-only parking permit, and they shall only use said permit for his/her own vehicle(s) or that of his/her guests.
(d) 
All temporary resident-only parking permits shall be conspicuously displayed on the vehicle's rear view mirror or front dashboard.
(e) 
A temporary resident-only parking permit shall not:
(1) 
Guarantee or reserve any parking space(s) within a designated zone; and
(2) 
Authorize the stopping, standing or parking of any vehicle in such places and during such times when such stopping, standing, or parking is prohibited or restricted by regulations other than those established under this division.

(a) 
A person commits an offense if he stops, stands, or parks a motor vehicle in a temporary resident-only permit parking zone without displaying a valid temporary resident-only parking permit on the vehicle as required under this division.
(b) 
A person commits an offense if he displays or allows the display of a temporary resident- only parking permit on a motor vehicle contrary to section 12.07.146(c) above.
(c) 
A person commits an offense if he falsely represents himself as being eligible for additional temporary resident-only parking permits and/or makes a false statement of a material fact on his application for additional permits.
(d) 
A lawful holder of a temporary resident-only parking permit commits an offense if he sells, barters, or trades said permit to another person and/or entity.
(e) 
It shall be a defense to prosecution under this division that at the time of the stopping, standing or parking, the person was:
(1) 
Expeditiously loading or unloading passengers or property;
(2) 
Providing a maintenance, repair, delivery, or lawn service to a residence located within the temporary resident-only permit parking zone(s);
(3) 
In the performance of official duties as a law enforcement officer, government employee or contractor or utility company employee or contractor;
(4) 
Duly-qualified for Texas Transportation Code section 681.006 parking privileges; or
(5) 
Operating an authorized emergency vehicle in the performance of official duties.
(f) 
The Director may revoke the temporary resident-only permit parking privilege of anyone who violates any provision of this division or who has an unresolved parking citation issued by the Town and which is in warrant status with the Town’s Municipal Court.

It shall be unlawful for any person to remove any sign or signs placed by the order of the Director designating the temporary no-parking zone and/or the temporary resident-only permit parking zone.
