All medical marijuana facilities and uses shall remain in compliance
with Article XVI, Section 1 of the State of Missouri Constitution.

A. No medical marijuana facility shall be operated or maintained within
one hundred (100) feet of an existing elementary or secondary school,
licensed child care center, or church.

In the case of a freestanding medical marijuana facility, the
distance between the facility and the school, child care center, or
church shall be measured from the property line of the facility to
the closest point of the property line of the school, child day care
center, or church.

In the case of a facility that is part of a larger structure,
such as an office building or strip mall, the distance between the
facility and the school, day care, or church shall be measured from
the property line of the school, child care center, or church to the
facility's entrance or exit closest in proximity to the school,
child day care center, or church.

A. Outdoor Operations Or Storage Prohibited. All operations and all
storage of materials, products, or equipment at medical marijuana
facilities shall be within a fully enclosed building. No outdoor operations
or storage shall be permitted.
B. Onsite Usage Prohibited. No medical marijuana may be smoked, ingested,
or otherwise consumed on the premises of a medical marijuana facility.
C. Display Of Licenses Required. The medical marijuana license issued
by the State of Missouri Department of Health and Senior Services
shall be displayed in an open and conspicuous place on the premises.
D. Ventilation Required. All medical marijuana facilities shall install
and operate a ventilation system that will prevent any odor of marijuana
from leaving the premises of the business. No odors shall be detectable
by a person with a normal sense of smell outside the boundary of the
parcel on which the facility is located.

A. Medical marijuana dispensaries shall not be open to the public or
make any sales between the hours of 10:00 P.M. and 8:00 A.M.
B. Any medical marijuana dispensary shall require any customer to display
the customers permit card from the Department of Health and Senior
Services or other proof of eligibility at the time of each purchase.
C. No person under the age of eighteen (18) years old shall be allowed
into a medical marijuana dispensary; except that a Qualifying Patient
who is under the age of eighteen (18) years but who has been emancipated
by a court and a Qualifying Patient, under the age of eighteen (18)
years when accompanied by the Qualifying Patient's parent or
guardian.
