The city is responsible for protecting the drinking water supply from contamination or pollution which could result from improper private water distribution system construction or configuration. The purpose of this backflow prevention program is to ensure compliance with state regulations governing this protection. The city enforces these regulations and restrictions to ensure the public health and welfare.

The city hereby adopts the state commission on environmental quality’s (TCEQ) Rules and Regulations for Public Water Systems, as found in 30 TAC chapter 290, subchapter D, and made a part hereof as if set out in its entirety.

(a) 
For the purpose of establishing uniform rules and regulations, the city hereby adopts the Code known as the 2006 International Plumbing Code thereof, including appendices A through G, inclusive, save and except such portions as are hereinafter amended or deleted, of which a true and correct copy has been and now is filed in the office of the city secretary, and the same is hereby adopted and incorporated as if fully set out at length herein, and the provisions thereof shall be considered in the construction, alteration or repair of all plumbing in or for the city.

Any person violating any provision of said plumbing code shall be punished as provided in this code.

The assessment of hazard and the determination of required backflow prevention devices shall be guided by the TCEQ rules and regulations, section 290.47(i), appendix I “Assessment of Hazard and Selection of Assemblies,” which is made a part hereof as if set out in its entirety. Guidance shall also be from the International Plumbing Code, Chapter 6 “Water Supply and Distribution,” Section 608 “Protection of Potable Water Supply.”

Under the supervision of the director of public works and/or his or her designated representative or agent, the department of public works shall have primary responsibility for the oversight and operation of the backflow prevention program. The utility administration division within the administrative services department and the code enforcement division within the community development department shall provide support to the backflow prevention program as may be pertinent to their responsibilities.
