(a) This section shall be administered by and under the direction of
the chief of police.
(b) Whenever any police office of the city, or any other peace officer,
finds any character of private property unattended in or upon any
public street, highway, road or alley, or any part or portion thereof,
within the city in violation of any ordinance of the city or law of
the state governing, regulating or controlling such private property
in and upon public streets, highways, roads and alleys, such officer
is authorized to remove or cause to be removed any such character
of private property.
(c) It shall be unlawful for any person to leave or cause to be left
any character of private property in or upon any public street, highway,
road or alley within the city or in or upon any part or portion thereof
unattended for a longer continuous period of time than forty-eight
(48) hours. Any character of private property so left or caused to
be left for such period of time shall be deemed to have been abandoned
by the owners or persons in charge of same or having the control,
care, custody or possession thereof, as well as by any lienholder
thereof, and the leaving or causing to be left of the same in such
an unattended state for such period of time shall be prima facie evidence
of an intention on the part of such owners or persons in charge or
same or having the control, care, custody or possession thereof to
abandon the same.
(d) It shall be unlawful for the owner of any character of private property
found in or upon any public street, highway, road or alley within
the city or in or upon any part or portion thereof in violation of
any provision of any ordinance of the city or any law of the state
or under circumstances prohibited by this section, or for any person
in charge of any such private property or having control, care, custody
or possession of same to willfully of knowingly fail or refuse to
remove the same in accordance with the provisions hereof when lawfully
ordered so to do by a police officer of the city or other peace officer
or any firefighter of the city.
