This article shall be known as and
may be cited as the building code of the city.

This article provides standards to
preserve and promote the health, safety, property and general welfare
of the people by regulating and controlling the design, construction,
quality of materials, surface water, use and occupancy, location and
maintenance of buildings and structures within the city, and certain
electrical, plumbing, and mechanical equipment specifically regulated
herein.

The provisions of this article, and
the adopted City of Lakeway Design Manual, shall apply to the erection,
construction, enlargement, alteration, major repair, re-roofing, re-siding,
moving, improving, converting, using or occupying of any building
or structure in the city. Whenever the standards and specifications
in this article conflict with those contained in another ordinance,
the most stringent or restrictive provision shall govern. However,
the requirements of the design manual shall supersede all conflicting
standards and specifications.

For the purposes of this article, the definitions of terms, phrases, words, and their derivations shall have the meaning and effect ascribed to them in section
22.02.001. Words used in this article and not supplied in section
22.02.001 shall be obtained from current editions of the International Building Code, International Residential Code for One- and Two-Family Dwellings, International Fire Code, Uniform Plumbing Code, International Mechanical Code for Commercial, National Electrical Code, and International Energy Conservation Code for One- and Two-Family. All other words shall have their ordinarily accepted meaning.

(a)
It shall be unlawful for any person,
firm, corporation, partnership, or association to commence any project
or activity, in the city, contrary to or in violation of any provisions
of this article, or to cause, permit or suffer the same to be done.
(b)
Any person violating any provision of this article shall be guilty of a misdemeanor and subject to punishment as provided in section
1.01.009.
(c)
The issuance of a permit based upon
plans and specifications shall not prevent the code official or authorized
designee from thereafter requiring the correction of errors in said
plans and specifications, or from preventing building operations being
carried on thereunder when in violation of this article or of any
other ordinances of the city.
(d)
Prosecution or conviction under this
provision shall not be a bar to any other remedy or relief for violation
of this article.
