The following code is hereby adopted by the city, and all construction
in the city shall conform to the standards set out in the following
code published by the International Code Council, Inc., with amendments
as published: 2021 International Fire Code.

The fire code official as described in the 2021 International
Fire Code shall be the fire marshal of the city.

Notwithstanding section 907 of the International Fire Code,
no person shall be required to install and maintain smoke detectors
in single-family dwellings, except where required by law. All multi-dwelling
units shall comply with section 907.

(a) Unlawful.
It shall be unlawful for any person to possess,
store, offer for sale, expose for sale, sell at retail or use or explode
any fireworks within the corporate limits of the city or within five
thousand (5000) feet outside the city limits; provided, however, that
the fire marshal is hereby authorized to issue permits for the possession,
use and discharge of supervised public displays of fireworks to qualifying
operators approved by the fire marshal. This section shall not apply
within any portion of such five thousand foot area which is contained
within the territory of another municipality.
(b) Penalty.
The doing or performing of any act in violation of subsection
(a) shall be a violation of this Code of Ordinances.
(c) Display permits.
Applications for display permits shall
be made in writing to the fire marshal at least ten (10) days in advance
of the date of display. The permittee shall furnish a bond or certificate
of insurance in a minimum amount of five thousand dollars ($5,000)
for the payment of all damages which may be caused either to a person
or persons or to property by reason of the permitted display and arising
from any acts of the permittee, his agents, employees or subcontractors.
Such applicant shall identify his previous experience in handling
and discharge of fireworks or shall otherwise demonstrate to the reasonable
satisfaction of the fire marshal his competency to handle said fireworks.
In the event the fire marshal denies a permit to the applicant, said
applicant may appeal the fire marshal’s decision to the city
manager by filing a written appeal with the city secretary requesting
a hearing. Said appeal shall be heard by the city manager not later
than fifteen (15) days after the date said written appeal is filed
with the city secretary.
(d) Enforcement.
The chief of police, fire chief, or fire
marshal or their designees are hereby authorized to seize, take, remove
or cause to be removed at the expense of the owner, any stock of fireworks
offered or exposed for sale, stored, held, possessed or discharged
by any person in violation of this article.
(e) Display permit fee.
A nonrefundable display permit fee,
as established by city council, shall be assessed when such permit
is requested.

The following local amendment shall be made to the adopted 2021
International Fire Code:
Section 506.1. Where required. Lock
boxes are required in commercial structures where access to or within
a structure or an area is restricted because of secured openings or
where immediate access is necessary for life-saving or firefighting
purposes. An exception to this requirement exists for any commercial
building with construction completed prior to the passage of this
section. For any commercial building constructed prior to adoption
of this section, where the owner is seeking to obtain a remodel or
addition permit, a lock box must be installed on said commercial building
as part of the remodel or addition. The owner of any commercial building
constructed prior to the passage of the ordinance may, but is not
required to, install a lock box as provided by this section. However,
the owner of any commercial building constructed prior to the passage
of this section that chooses to not install a lock box as provided
by this section shall be required to sign a waiver releasing the City
of Liberty from any liability resulting from damages caused when accessing
their commercial building.
