A. 
Chapter 441 of Title 67 of the Pennsylvania Code, entitled "Access to and Occupancy of Highways by Driveways and Local Roads," promulgated by the Pennsylvania Department of Transportation, as existing on the date of adoption of this article, be and hereby is adopted as the regulations for occupancy of highways within the Borough of Narberth, and each and all of the regulations in said Chapter 441 of Title 67 of the Pennsylvania Code, except as provided in this article, are hereby referred to, adopted and made a part hereof as if fully set forth out in this article, with the additions, deletions and changes, if any, enumerated in this article.
B. 
Narberth Borough specifically amends certain provisions of Chapter 441 of Title 67 of the Pennsylvania Code, as follows:
(1) 
The definitions set forth in Section 441.1 of Title 67 of the Pennsylvania Code are hereby modified as follows:
CENTRAL PERMIT OFFICE
The Narberth Borough Hall located at 100 Conway Avenue, Narberth, Pennsylvania.
COMMONWEALTH
Narberth Borough.
COUNTY OFFICE
The Narberth Borough Hall located at 100 Conway Avenue, Narberth, Pennsylvania.

The Narberth Borough Hall located at 100 Conway Avenue, Narberth, Pennsylvania.
HIGHWAY
A highway or bridge within the system of Borough highways and bridges, including the entire width between right-of-way lines, over which the Borough has assumed or has been legislatively given jurisdiction.
(2) 
Section 441.4, Permit Fees, shall be amended as follows:
"Applicants for permits under this article shall pay to the Borough at the time of application the fee set forth on the then current fee schedule which shall have been adopted by resolution or ordinance of the Borough Council. A permit shall not be issued until the designated fees have been paid."
C. 
Pursuant to Section 441.6(2)(i)(F), the Borough enacts the following provisions in order to further protect the health, safety and welfare of Borough residents:
(1) 
Section 441.6(1)(viii) is deleted and replaced with the following:
"A permit shall be valid as long as the traffic volume of the driveway does not exceed 5% of the approved volume, or in the case of driveways existing prior to enactment of this provision, 5% of existing traffic volumes."
(2) 
Section 441.6(1) is amended by the addition of a new section (x), as follows:
"Any changes to the property, its structures or uses, that results in an increase in existing or approved traffic volumes greater than 5% shall invalidate any existing permit issued for the property, or, in the case of driveways existing prior to the enactment of these provisions, shall require the owner to apply for a permit subject to all the provisions of this act."
(3) 
Section 441.7(c)(3) is deleted and replaced with the following:
"Access to a property which abuts two or more streets or highways shall be restricted to only that roadway which can more safely accommodate its traffic."
(4) 
Section 441.7(c)(4) is deleted and replaced with the following:
"The Department shall require the permittee to locate an access driveway or local road across from a highway, local road or access driveway on the opposite side of the roadway if it is located within 150 feet, measured along the intersecting road center line, of the highway, local road or access driveway on the opposite side of the roadway, and sufficient property is available on the permittee's property."
(5) 
Section 441.7(e) is amended by the addition of a new subparagraph (4), as follows:
"For properties requiring only the use of low volume and minimum use driveways, as defined elsewhere in this section, to support the existing and projected traffic volumes, only one driveway or access point shall be permitted on any one roadway, regardless of site frontage."
(6) 
Section 441.8(a)(2) is amended by the addition of the following sentence:
"Unless classified as a local road under Section 441.7(d), the driveway design dimensions shall not exceed the maximum values nor be less than the minimum values in section 441.9, Figures 7 through 12."
(7) 
Section 441.8(h)(1) is deleted and replaced with the following:
"Access driveways shall be located at a point within the property frontage limits which provide at least the minimum sight distance listed in the appropriate following table, subject to the requirements of section 441.8(h)(2)(ii):"
(8) 
Section 441.8(h)(2)(ii) is deleted and replaced with the following:
"Posted speeds shall only be used when operating speeds are less than the posted speeds. When operating speeds are equal or exceed the posted speed limit, the 85th percentile speed shall be used in determining compliance with Section 441.8(h)(1)."
(9) 
Section 441.8(h)(2)(iv) is deleted and replaced with the following:
"The sight distance values in Tables 1 through 6, as supplemented by Section 441.8(h)(2)(ii), are desirable for the safe operation of the driveway or local road. Sight distance values less than desirable will be accepted only if it is impossible to achieve the desirable value by locating the driveway at any point within the property frontage boundaries. Furthermore, the permittee may apply the minimum acceptable sight distance value in one direction only, that is, vehicles exiting the driveway or local road must meet the desirable sight distance criteria in at least one direction, left or right, with the other direction meeting the minimum requirements. The minimum acceptable sight distance values shall be computed from the following formula:"
