Any person violating or failing to comply with any provision of this article shall be fined, upon conviction, in an amount not more than $500.00. Separate offenses shall be deemed committed each day during or on which a violation occurs or continues.

The purpose and intent of this article is to provide minimum standards, provisions and requirements and to provide for suitable materials and methods of construction for newly constructed or reconstructed residential or commercial driveways and parking lots hereafter constructed or reconstructed within the corporate limits of the city or within any subdivision of the city located in the extraterritorial jurisdiction of the city.

All new driveways and parking lots and all existing driveways and parking lots being constructed or reconstructed within the corporate limits of the city or within any subdivision located in the extraterritorial jurisdiction of the city shall be constructed or reconstructed to provide and meet the following minimum standards, materials and methods of construction:
(1) 
Driveways and fire lanes.
(A) 
Residential.
Minimum ten feet wide, five-inch (5") concrete, #3 rebar, 18-inch on center each way, and 3,600 psi.
(B) 
Commercial.
Nonfire lane parking shall be a minimum of five inch (5") concrete, #3 rebar, 18-inch on center each way, 30-foot turning radius, 3,600 psi on six-inch lime stabilized subgrade. Two inches (2") extra concrete may be used in lieu of lime or cement-stabilized subgrade.
(C) 
Fire lanes.
Fire lanes shall be a minimum of six (6) inches thick with a six inch (6") lime or cement stabilized subbase, #3 rebar, 18-inch on center each way, 30-foot turning radius, and have a minimum strength of 4,000 psi. Two inches (2") extra concrete may be used in lieu of lime or cement-stabilized subgrade.
(2) 
Parking lots.
(A) 
Permanent parking lots (nonfire lane).
Minimum five-inch concrete, #3 rebar, 18-inch on center each way, 3,600 psi on compacted subgrade.
(B) 
Not-for-profit temporary parking lots.
Allowed only for not-for-profit organizations, as defined by the Internal Revenue Service (IRS), and limited to a maximum of three (3) years.
(i) 
Permit required.
(ii) 
Proof of not-for-profit status must be provided with the application.
(iii) 
Applicants must own the property on which the temporary parking will be placed.
(iv) 
Applicants who are requesting a temporary parking lot for overflow parking for an existing land use must have met or meet all the required parking for the land use with permanent parking constructed to the standards listed in subsection (2)(A), above.
(v) 
Applicants who are requesting a temporary parking lot for a new structure must agree to provide the required parking for the land use with permanent parking constructed to the standards listed in subsection (2)(A), at the end of the time period allowed for the temporary unpaved parking lot. Failure to install permanent parking for all required spaces may result in the loss of the certificate of occupancy.
(vi) 
Extensions of up to twelve (12) months may be allowed at the discretion of the city manager.
(vii) 
Material allowed: Gravel.
(viii) 
Materials not allowed: Mulch, grass, and shredded recycled rubber tires.
(3) 
Dumpster pads and related sites.
Minimum six inch (6") concrete, #3 rebar, 18-inch on center each way, six-inch lime or cement stabilized subgrade. Two inches (2") extra concrete can be used in lieu of lime or cement stabilized sub-base.
