Unless otherwise noted in the following subsections or in the
bylaws of the board, commission or committee, the following standards
shall apply to all boards, commissions and committees:
(1) The
term of office shall be two (2) years. The two-year requirement may
be adjusted with the approval of both the city council and the affected
board member.
(2) The
appointments shall be staggered so that to the extent possible one-half
(1/2) of each board, commission or committee shall expire at one (1)
time each year.
(3) These
provisions shall not preclude the reappointment of a member to a board,
commission, or committee.
(4) Each
of the six council members and the mayor can nominate their designated
appointee. Should the board have more than seven (7) members, the
remaining members shall be nominated by the city council. All appointments
shall be announced at a city council meeting and made a part of the
minutes.
(5) A person
appointed after the expiration of a term shall hold office for the
remainder of the term. Board, commission, or committee members shall
continue to hold office until their replacement has been appointed.
However, in the event that the city council denies a motion to reappoint
a person to a board, commission or committee or approves a motion
to not reappoint a person to a board, commission or committee, that
person shall not serve beyond the date that the person’s term
expires.
(6) The
animal shelter advisory committee, board of survey, Odessa Development
Corporation, planning and zoning commission and zoning board of adjustment
shall have an attendance requirement equal to 1/2 of all of the regularly
scheduled annual meetings of that board. Any member who is absent
from more than one-half (1/2) of the regular meetings scheduled in
one (1) year, will be automatically removed from the board.
(7) The
board, commission or committee shall adopt its own rules governing
its procedures and matters coming before it.
(8) The
members of the board, commission or committee shall serve without
compensation.

The animal shelter advisory committee as previously established
under section 823.005 of the Texas Health & Safety Code shall
continue as follows:
(1) Purpose.
The purpose of the animal shelter advisory committee is to advise
and assist animal control in development of policy and procedures
for operation of the animal shelter.
(2) Membership.
The advisory committee must be composed of at least one licensed
veterinarian, one county or municipal official, one person whose duties
include the daily operation of an animal shelter, and one representative
from an animal welfare organization.
(3) Nature
of committee.
The committee is advisory in nature. The
committee shall report to and be solely responsible to the city council.
The committee shall not have responsibility or authority over the
public officials or employees of the city in the implementation of
related programs or operations.
(4) Meetings.
The committee shall meet at least three times a year.

The board of survey as previously established under section
3-10-2 of the City Code of Ordinances shall continue as follows:
(1) Purpose.
The purpose of the Board of Survey is to determine what action
should be taken regarding buildings which the official has classified
as not meeting the safety standards of the city, and which the owners,
mortgagees or lienholders have failed to or refused to remove or repair.
(2) Membership.
The board shall consist of seven (7) members who shall each
be individually appointed by one of the six city council members and
the mayor with approval of the city council.
(3) Nature
of board.
The board is decision making in nature. Decisions
of the board can be formally appealed to city council.
(4) Meetings.
The board shall meet upon notice of the dangerous building official.
Public notice of all board meetings shall be given, which notice shall
comply with all applicable provisions of state law and city ordinance.

The building board of appeals as previously established under the International Building Code, adopted as article
3-2 of the City Code of Ordinances, appendix
B, board of appeal shall continue as follows:
(1) Purpose.
The purpose of the building board of appeals is to hear and
decide appeals or orders, decisions or determinations made by the
building official relative to the application and interpretation of
the building code; one- and two-family dwelling code; the plumbing
code; the fuel and gas code; the mechanical code; the electrical code;
the energy conservation code; the existing building code; the performance
code; or the property maintenance code.
(2) Membership.
The board shall consist of seven (7) members who shall each
be individually appointed by one of the six city council members and
the mayor with approval of the city council. The city council may
appoint two (2) alternate members of the building board of appeals,
who shall serve in the absence of one (1) or more of the regular members
when requested to do so.
(3) Nature
of board.
The board is decision making in nature.
(4) Meetings.
The board shall meet upon notice of the chairman or the building
official, within ten (10) days of the filing of an appeal or at stated
periodic meetings. Public notice of all board meetings shall be given,
which notice shall comply with all applicable provisions of state
law and city ordinance.

The capital improvement advisory committee as previously established
under section 395.058 of the Texas Local Government Code and adopted
by Resolution No. 2020R-51 shall continue as follows:
(1) Purpose.
The purpose of the capital improvement advisory committee is
to advise and make recommendations to the city council regarding land
use assumptions, capital improvements plan, and impact fees.
(2) Membership.
The committee shall consist of not less than five (5) members
who shall be appointed by a majority vote of the governing body of
the political subdivision. The members shall be a representative of
the city’s ETJ, 3 members from real estate, development, or
building industry, and interested individual(s).
(3) Terms
of members.
The terms of members shall be four (4) years.
(4) Nature
of committee.
The committee is advisory in nature. The
board shall report to and be solely responsible to the city council.
The board shall not have responsibility or authority over the public
officials or employees of the city in the implementation of related
programs or operations.
(5) Meetings.
The committee shall meet as needed.
(6) Rules.
The governing body of the political subdivision shall adopt
procedural rules for the advisory committee to follow in carrying
out its duties.

The citizens golf advisory committee as previously established
shall continue as follows:
(1) Membership.
The committee shall consist of seven (7) members who shall each
be individually appointed by one of the six city council members and
the mayor with approval of the city council and the director of parks
and recreation or his or her duly appointed representative shall serve
as an ex officio non-voting member of the committee.
(2) Terms
of members; vacancies.
The terms of members shall be
three (3) years; but shall be staggered so that no more than four
(4) of said members’ terms shall expire at any one time. A quorum
shall consist of four (4) members.
(3) Chairman
and vice-chairman.
The committee shall annually elect
from among its voting membership a chairman and vice-chairman to preside
over its meetings, who shall continue to have a right to vote.
(4) Secretary.
The secretary to the director of parks and recreation shall
serve as secretary for the committee, taking the minutes and posting
and furnishing all necessary notices of meetings.
(5) Nature
of committee.
The committee is advisory in nature. The
board shall report to and be solely responsible to the city council.
The board shall not have responsibility or authority over the public
officials or employees of the city in the implementation of related
programs or operations.
(6) Meetings.
A regular meeting of the committee shall be held as needed.
The meeting time and location shall be set by the committee. Meetings
may be called by the chairman, vice-chairman or three (3) voting members
of the committee.
(7) Duties
and responsibilities.
The duties and responsibilities
of the committee shall be as follows:
(A) Hear
citizen complaints or other comments regarding all matters related
to the Ratliff Ranch Golf Links.
(B) Be
generally informed concerning any matters that relate to the Ratliff
Ranch Golf Links.
(C) Regularly
report and make recommendations to the city council regarding all
matters related to the Ratliff Ranch Golf Links.
(D) Identify
any problems or needs that exist in regard to the Ratliff Ranch Golf
Links and develop proposed solutions and recommendations.
(E) Complete
any special projects or requests of the city council relating to the
Ratliff Ranch Golf Links.

The Ector County-Odessa Joint Airport Zoning Board as previously
established under the Airport Zoning Act, chapter 241 of the Texas
Local Government Code, and created by Ordinance 86-43 shall continue
as follows:
(1) Purpose. The purpose of the joint airport zoning board
is to adopt, administer and enforce airport zoning regulations applicable
to airport hazard areas in the city and county.
(2) Membership. The board shall consist of five (5) members,
two (2) to be appointed by the city council and two (2) members to
be appointed by the commissioners' court of the county. The fifth
member shall be elected by a majority of the members so appointed
and said fifth member shall serve as chairman of the board.
(3) Nature of the board. The board is decision making in
nature.
(4) Meetings. The board shall meet as needed.

The historic preservation commission as previously established under section
14-3-2 of the City Code of Ordinances shall continue as follows:
(1) Purpose.
The purpose of the historic preservation commission is to protect
and enhance the landmarks and districts of the city’s historic,
architectural, and cultural heritage; foster civic pride in the accomplishments
of the past; protect and enhance the city’s attractiveness to
visitors; ensure the harmonious, orderly, and efficient growth and
development of the city; promote economic prosperity and welfare of
the community; and encourage stabilization, restoration, and improvements
of such properties and their values.
(2) Membership.
The commission shall consist of seven (7) members to be appointed
by the city council and a historic preservation officer to be appointed
by the city manager which shall serve as an ex officio non-voting
member.
(3) Nature
of commission.
The commission is advisory in nature.
The commission shall report to and be solely responsible to the city
council. The commission shall not have responsibility or authority
over the public officials or employees of the city in the implementation
of related programs or operations.
(4) Meetings.
The commission shall meet at least monthly if business is at
hand.

The mayor’s drug and crime commission as previously established
by Resolution 91R-01 and as amended shall continue as follows:
(1) Purpose.
The purpose of the mayor’s drug and crime commission is
to develop strategies to eliminate drug use, reduce crime and maintain
communication with law agencies, schools and citizens.
(2) Membership.
The commission shall consist of persons identified by positions
in the community.
(3) Nature
of commission.
The commission is advisory in nature.
The commission shall report to and be solely responsible to the city
council. The commission shall not have responsibility or authority
over the public officials or employees of the city in the implementation
of related programs or operations.
(4) Meetings.
Meetings shall be conducted when called by the chairman, by
the secretary or by a majority of the commission.

The Midland Odessa Urban Transportation District (MOUTD) Board
of Directors as previously established by Interlocal Agreement and
the Bylaws of MOUTD Board shall continue as follows:
(1) Purpose.
The purpose of MOUTD is to provide oversight of the transit
system operating in Midland and Odessa.
(2) Membership.
MOUTD shall consist of 12 members (6 from Midland, 6 from Odessa).
In addition, the city managers for Midland and Odessa shall each nominate
one (1) ex officio non-voting member as the designated representative
for the city.
(3) Nature
of MOUTD.
MOUTD is decision making in nature.
(4) Meetings.
Meetings shall be held on the 4th Wednesday of each month.

The Odessa Development Corporation Board of Directors as previously
established under Sec. 501.062 of the Texas Local Government Code
and the bylaws of the Odessa Development Corporation shall continue
as follows:
(1) Purpose.
The purpose of the Odessa Development Corporation is to promote
and develop industrial and manufacturing enterprises and bring in
new jobs, and any other purpose allowed under the Economic Development
Act.
(2) Membership.
The board shall consist of seven (7) members. Each of the six
city council members and the mayor shall nominate one (1) member to
be approved by the city council.
(3) Nature
of board.
The board is advisory in nature. The board
shall report to and be solely responsible to the city council. The
board shall not have responsibility or authority over the public officials
or employees of the city in the implementation of related programs
or operations.
(4) Meetings.
The board shall hold regular meetings on the second Thursday
of each month at 2:00 p.m., unless such meeting is cancelled or rescheduled
by a majority of the board. Special meetings of the board may be called
by the president, by the secretary, by a majority of the directors,
by the mayor of the city, or by a majority of the city council.

The Odessa Housing Finance Corporation Board of Directors as
previously established under Sec. 394.021 of the Texas Local Government
Code and the bylaws of the Odessa Housing Finance Corporation shall
continue as follows:
(1) Purpose.
The purpose of the Odessa Housing Finance Corporation is to
provide a means to finance the cost of residential ownership and development
that will provide decent, safe, and sanitary housing at affordable
prices for residents of local governments.
(2) Membership.
The board shall consist of seven (7) members to be appointed
by the city council.
(3) Terms
of members.
The terms of members shall be three (3) years;
but shall be staggered so that to the extent possible one-half (1/2)
of each board shall expire at one (1) time each year.
(4) Nature
of board.
The board is decision making in nature.
(5) Meetings.
The board shall meet at least annually.

The parks and recreation advisory board as previously established
shall continue as follows:
(1) Purpose.
The purpose of the parks and recreation advisory board is to
hear citizen complaints or other comments regarding all matters related
to parks and recreation activities in the city.
(2) Membership.
The board shall consist of seven (7) city residents who shall
each be individually appointed by one of the six city council members
and the mayor with approval of the city council and. the director
of parks and recreation or his or her duly appointed representative
shall serve as an ex officio non-voting member of the board. A quorum
shall consist of four (4) members.
(3) Absenteeism.
If any member is absent in excess of fifty (50) percent of the
regular advisory board meetings for any six-month period, the city
council shall declare the position forfeited and a vacancy to exist
and shall fill said vacancy as soon as possible as hereinafter set
forth.
(4) Chairman.
The board shall annually elect from among its voting membership
a chairman and vice-chairman to preside over its meetings, who shall
continue to have a right to vote.
(5) Secretary.
The secretary to the director of parks and recreation shall
serve as secretary for the board, taking the minutes and posting and
furnishing all necessary notices of meetings.
(6) Nature
of board.
The board is advisory in nature. The board
shall report to and be solely responsible to the city council. The
board shall not have responsibility or authority over the public officials
or employees of the city in the implementation of related programs
or operations.
(7) Meetings.
A regular meeting of the board shall be held at least once a
month at a time to be set by the board. Special or emergency meetings
may also be called by the chairman, vice-chairman or four (4) voting
members of the board.
(8) Duties
and responsibilities.
The duties and responsibilities
of the board shall be as follows:
(A) Hear citizen complaints or other comments regarding all matters related
to parks and recreation activities in the city.
(B) Be generally informed concerning any matters that relate to parks
and recreation matters in the city.
(C) Regularly report and make recommendations to the city council regarding
all matters related to parks and recreation activities in the city.
(D) Identify any problems or needs that exist in regard to parks and
recreation in the city and develop proposed solutions and recommendations.
(E) Complete any special projects or requests of the city council relating
to parks and recreation.
(9) Subcommittees.
The board, at its discretion, may appoint special subcommittees
on various parks and recreation issues. These subcommittees shall
contain at least two (2) parks and recreation advisory board members
appointed by the full board and other subcommittee members appointed
by the director of parks and recreation. The subcommittee shall appoint
a chairman who shall be one (1) of the parks and recreation advisory
board members and who shall report the subcommittee’s activities
to the full board. Further duties of the subcommittee may be assigned
at the discretion of the parks and recreation advisory board.

The planning and zoning commission as previously established under section 211.007 of the Texas Local Government Code and article
IV of the city charter shall continue as follows:
(1) Purpose.
The purpose of the planning and zoning commission is to make
recommendations to the city council regarding planning and zoning
matters.
(2) Membership.
The commission shall consist of seven (7) members who shall
each be individually appointed by one of the six city council members
and the mayor with approval of the city council. The commission shall
also consist of two (2) alternate members who shall be appointed by
the city council as a whole. A quorum shall consist of four (4) members.
(3) Nature
of commission.
The commission is advisory in nature.
The commission shall report to and be solely responsible to the city
council. The commission shall not have responsibility or authority
over the public officials or employees of the city in the implementation
of related programs or operations.
(4) Meetings.
The commission shall meet at least monthly if business is at
hand. Unless otherwise required by state law or by the city charter,
the affirmative vote of a majority of the planning and zoning commission
members attending any meeting at which there is a quorum present shall
be necessary and sufficient to adopt any item.

The tax incentive committee as previously established by Resolution
No. 2011R-62 and as amended shall continue as follows:
(1) Purpose.
The purpose of the tax incentive committee is to make recommendations
to the city council regarding all tax incentive guidelines, policies
and tax incentive applications.
(2) Membership.
The committee shall consist of eleven (11) members.
(3) Nature
of committee.
The committee is advisory in nature. The
committee shall report to and be solely responsible to the city council.
The committee shall not have responsibility or authority over the
public officials or employees of the city in the implementation of
related programs or operations.
(4) Meetings.
A regular meeting of the committee shall be held at a time to
be established by the committee. Special or emergency meetings may
also be called by the chairman, vice chairman or four (4) voting members
of the committee.

The traffic advisory committee as previously established shall
continue as follows:
(1) Purpose.
The purpose of the traffic advisory committee is to strengthen
citizen input and involvement in the area of traffic safety.
(2) Membership.
The committee shall consist of seven (7) regular members who
shall each be individually appointed by one of the six city council
members and the mayor with approval of the city council. There shall
also be non-voting members assigned to assist the committee from the
city traffic engineering division, the city police department, and
Ector County Independent School District.
(3) Terms
of members.
The terms of members shall be three (3) years;
but shall be staggered so that no more than four (4) of said members’
terms shall expire at any one time. A quorum shall consist of four
(4) members.
(4) Nature
of committee.
The committee shall be advisory in nature.
The committee shall report to and be solely responsible to the city
council. The committee shall not have responsibility or authority
over the public officials or employees of the city in the implementation
of traffic safety programs or operations.
(5) Meetings.
Meetings shall be held not less than once every three (3) months
or as otherwise determined by the committee.
(6) Duties
and responsibilities.
The duties and responsibility of
the traffic advisory committee shall include, but not necessarily
be limited to:
(A) Encourage and promote programs within the community which will bring
about citizens’ awareness and support of traffic safety;
(B) Receive and consider information of a traffic safety nature that
citizens should be aware of;
(C) Make recommendations to those public officials who can administer
and implement corrective action on matters of traffic safety and traffic
congestion;
(D) Appoint such citizens, as may be deemed necessary, as non-voting
members, to assist in accomplishing programs and studies of the committee;
(E) Make recommendations regarding traffic safety ordinances or other
traffic safety matters requiring city council consideration;
(F) Conduct public hearings concerning traffic safety.

The zoning board of adjustment as previously established under section 211.008 of the Texas Local Government Code and section
14-15-1 of the City Code of Ordinances shall continue as follows:
(1) Purpose.
The purpose of the zoning board of adjustment is to make special
exceptions to the terms of the zoning ordinance that are consistent
with the general purpose and intent of the ordinance and in accordance
with any applicable rules contained in the ordinance.
(2) Membership,
appointment.
The board shall consist of (7) members who
shall each be individually appointed by one of the six city council
members and the mayor with approval of the city council and (2) alternate
members appointed by the council as a group. A quorum shall consist
of four (4) members.
(3) Nature
of board.
The board is decision making in nature.
(4) Meetings.
Meetings of the board are held at the call of the presiding
officer and at other times as determined by the board.
