Pursuant to section 121.031, Texas Health and Safety Code, the city approves the Ector County health department to serve as the local health department for the city and authorizes the county health department to provide and enforce the public health services in the city referenced in section 121.032, Texas Health and Safety Code, and any other applicable state or federal statute. It is contemplated that the terms and conditions for the use of the county health department will be determined by an interlocal contract between the city and the county. Pursuant to section 121.033, Texas Health and Safety Code, the commissioners’ court of Ector County shall appoint the department director, who shall be the chief administrative officer of the local health department.

The health authority for the city shall be a physician that satisfies the requirements of state law and performs the duties prescribed by state law. The director of the county health department, subject to the approval of the city council and the county commissioners’ court, shall appoint a physician as the health authority in the local health department’s jurisdiction, as provided in section 121.033(d), Texas Health and Safety Code.
