(a) 
Residential accounts shall be all accounts serving one (1) to three (3) residential units on one (1) meter.
(b) 
Multifamily accounts shall be all accounts serving four (4) or more residential units on one (1) meter.
(c) 
Commercial accounts shall be all accounts that are not residential or multifamily or industrial.
(d) 
Industrial accounts shall be all accounts whose average monthly consumption during the previous year is at least one million (1,000,000) gallons per month and whose consumption during the month in which the city’s utility system is at peak production does not exceed one and one-half (1-1/2) times the customer’s average monthly consumption. In the event that there is not sufficient historical data to determine the type of rate classification and the applicable rates to be charged, the city may determine the proper classification based on the best available data.
(e) 
Outside city limits accounts shall be accounts outside the city.
(f) 
Industrial district accounts shall be accounts established for industrial districts.

Customers outside the city limits shall be charged pursuant to the appropriate rate schedule as listed above, multiplied by one and one-half (1-1/2) times the amounts set forth in the water rate schedules below.

Any industrial or commercial customer in an approved city industrial district paying a tax in lieu of annexation and agreeing to pay any necessary cost to extend water service to such customer shall pay the same water rate applicable for such customer as if inside the city limits.

(a) 
In order to qualify for the senior/disability residential rates, the person must show documentation that shows compliance with the following eligibility requirements:
(1) 
Senior.
The person is at least sixty-five (65) years of age.
(2) 
Disability.
(A) 
The person cannot engage in gainful work because of physical or mental disability;
(B) 
The person is at least fifty-five (55) years of age and blind and cannot engage in the person’s previous work because of blindness;
(C) 
The person receives disability benefits under the federal old-age, survivors and disability insurance program through the Social Security Administration; or
(D) 
The person is a disabled veteran with a disability rating by the Veterans’ Administration of at least fifty-one (51) percent.
(b) 
The senior/disability residential rate shall only be applicable to future billings and shall not be applicable for any period prior to establishing eligibility. The rate is available to eligible persons both inside and outside the city limits. However, it will not be applicable in the county utility district unless approved generally by the ECUD board of directors.

Energy surcharge.
An energy surcharge of $0.1133 per 1,000 gallons of water used shall be charged to all residential, multifamily, commercial and industrial water customers.
(e) 
Wholesale transactions and raw water.
Rates for wholesale transactions and CRMWD raw water shall be established by contract.

(c) 
Determination of consumption for residential users.
The consumption per month to be billed for residential users shall be the average of the monthly water consumption for the prior December, January, and February period, unless the user provides information on actual wastewater discharge. The average water consumption will be determined annually prior to April 1, to be charged and reflected on the statements which are mailed starting April 1 of each year and to be in effect until March 31 of the following year.
(d) 
Estimation of water consumption.
Water consumption for users that are not entirely on a metered basis shall be estimated and charged based on the average residential metered bill, which is determined by averaging the volume of consumption by all residential customers on the system.
(e) 
Maximum charges.
There is no maximum limit for wastewater charges for multifamily, commercial or industrial users.
(f) 
Determination of consumption for multifamily, commercial and industrial users.
The consumption per month to be billed for multifamily, commercial and industrial users shall be the actual metered water consumption for the month which is the basis of the bill, unless the user provides information on actual wastewater discharge. Water consumption for users that are not entirely on a metered basis shall be estimated and charged based on the best information available, including any metered water or sewage, and frequency and patterns of discharge.
(g) 
Commercial users with residential pattern of consumption.
Commercial users that apply and can show a residential pattern of consumption as determined by their utility billing records shall be charged in the same manner as a residential user.
(h) 
Excessive strength surcharges.
In addition to the above charges, commercial or industrial users whose water consumption is greater than or equal to five thousand (5,000) gallons per day and has a BOD and/or TSS concentration greater than or equal to two hundred fifty (250) mg/L or concentrations of other pollutants in excess of those found in normal domestic sewage will be assessed an excessive strength surcharge based on the following formula:
S = V x 8.34 [A(BOD-250) + B(TSS-250) + C(P-D)]
S = surcharge in dollars to be assessed on the monthly bill
V = water consumption in million gallons during the billing period
8.34 = factor to convert mg/L of BOD and/or TSS per million gallons to pounds
A = unit charge in dollars per pound BOD greater than 250 mg/L at $0.4307 per pound inside the city and $0.6461 outside the city
BOD = biochemical oxygen demand strength in milligrams per liter (mg/L) in user's discharge to the wastewater collection system
B = unit charge in dollars per pound TSS greater than 250 mg/L at $0.4454 per pound inside the city and $0.6680 outside the city
TSS = total suspended solids concentration in mg/L in the user's discharge to the wastewater collection system
250 = base level of BOD and TSS concentration in mg/L
C = unit charge in dollars per pound of pollutant from a user above a base level
P = concentration of a pollutant in the user's discharge to the wastewater collection system
D = base level of pollutant
P may be omitted if already accounted for under "other pollutant charges."
(i) 
Discontinuance of excessive strength surcharge.
In the event an excessive strength charge is required or assessed, it shall remain in effect until the condition is remedied by pretreatment as evidenced by a test of the discharge by the city. Testing to establish the surcharge will be conducted by the city laboratory at least once a year. The director of utilities may also determine if it is appropriate to consider analyses conducted by the customer.
(j) 
Other pollutant charges.
The user must pretreat wastes according to the regulations set forth in 40 CFR 403 and/or the city sewage quality control ordinance (article 13-5 of this chapter), whichever is the more stringent. However, in the event a violation occurs or the city incurs additional operation costs, then the following charges may be made:
(1) 
Any user that discharges pollutants that cause an increase in the cost of the operation and maintenance of the treatment works or disposal of the plant effluent or sludges, or regulatory fines, will pay an additional fee for such increased costs in addition to the basic monthly charges and the excessive strength surcharge.
(2) 
This charge shall be based on the calculations of the director of utilities.
(k) 
Other charges for discharge of special wastes.
A fee can be assessed for permits issued to discharge special wastes, including but not limited to pump test waters, into the wastewater collection system. The fee, as determined by the director of utilities, will be based on factors such as employee time used to research the project and issue the permit, the amount of water discharged to the wastewater collection system, and the inspections and analyses performed to monitor the project.
(l) 
Special metering requirement.
Customers who discharge wastewater regulated by the sewage quality control ordinance (article 13-5 of this chapter), as amended, and obtain all or a portion of their water from source(s) other than the city, may be required by the director of utilities to install and maintain a meter approved by the director.
