The city has and will continue to exercise all rights and powers of a municipal home-rule city to grant or refuse franchises for gas utilities that use the streets and alleys within its limits, to regulate and to make the statutory charges for the use, as authorized by law. Such powers and rights shall be exercised by ordinances and documents that are kept separate and apart from the city code.

The city has and will continue to exercise all rights and powers of a municipal home-rule city to make rate determinations with regard to gas utilities as provided by article 1446e, T.R.C.S., as now adopted or as hereafter amended. Such powers and rights shall be exercised by documents and ordinances that are kept separate and apart from the city code.
