(a) The
director shall have the right to enter any property used for any public,
commercial, or industrial purposes to determine the type of discharges
or potential discharges being made from the premises and to determine
whether the owner or other person having access to the property is
complying with all requirements of this division and any wastewater
discharge permit or order issued hereunder.
(b) The
director shall have the right to ready access to all parts of the
premises for the purposes of inspection, sampling, records examination
and copying, and the performance of additional duties pursuant to
this division.
(c) When
user has security measures in force which require proper identification
and clearance before entry into its premises, the user shall make
necessary arrangements with its security guards so that, upon presentation
of suitable identification, the director will be permitted to enter
without delay for the purposes of determining compliance with this
division.
(d) The
director shall have the right to set upon the user’s property
such devices as are necessary to conduct independent sampling and/or
metering of the user’s operations.
(e) The
director may require the user to install monitoring and sampling equipment
as necessary. This equipment shall be maintained in a safe and proper
operating condition by the user at the user’s expense.
(f) Any
temporary or permanent obstruction to safe and easy access to the
facility to be inspected or sampled shall be promptly removed by the
user at the user’s expense upon the written or verbal request
of the director and shall not be replaced.
(g) Unreasonable
delays in allowing the director access to the user’s premises
shall be a violation of this division.
(h) This
section is cumulative of all other authority.

If the director has been refused access to a building, structure,
or property, or any part thereof, used for public, commercial, or
industrial purposes and is able to demonstrate probable cause to believe
that there may be a violation of this division or that there is a
need to inspect and/or sample as a part of the routine inspection
and sampling program of the control authority designed to verify compliance
with this division or any permit or order issued hereunder, then the
director may seek issuance of an administrative search warrant from
the municipal court of the city or any magistrate or judge of a court
of record who shall issue such administrative search warrant. This
section is cumulative of all other authority.
