Editor’s note–Ordinance 85-28, sec. 4, adopted April 9, 1985, deleted art. IV, sections 33–42, in its entirety and added new provisions designated as art. IV, sections 33–35. Former sections 33–35 contained provisions regarding establishment, removal, filling vacancies, and organization of the planning and zoning board, while sections 36–42 pertained to the master plan of the city, plat approvals, and acceptance of public streets or grounds by the city. Former art. IV, sections 33–42, was derived from charter art. IV, secs. 1–10; and Ordinance 83-39, sec. 4, adopted April 12, 1983.
There shall be a planning and zoning commission which shall perform the duties of a city plan commission and a zoning commission as prescribed and authorized by the laws of the State of Texas. The city council shall determine the number and term of the members of the commission. The members shall possess the same qualifications as required for city council members and be real property taxpayers. The commission shall elect its own chairman. The adoption of this charter amendment shall not terminate the existing planning and zoning commission, previously referred to in the city charter as “planning board,” nor invalidate any of its acts; but its continued operations shall be pursuant to this amended section and any other charter amendments adopted herewith.

The members of the commission shall be subject to removal from office by the city council for any cause deemed by the city council sufficient for their removal in the interest of the public service; but, only after a public hearing before the city council on charges publicly made, if demanded by such members, within ten (10) days. Any vacancy in the membership of said commission shall be filled by the city council for the unexpired term of the member(s) whose place by removal or otherwise becomes vacant.

The commission shall have the following authority and responsibility:
(1) 
To conduct the necessary hearings and to recommend and report to the city council on all of the various zoning regulations, restrictions and boundaries to be adopted, amended, supplemented, changed, modified or repealed pursuant to state law.
(2) 
To approve or disapprove all plans, plats, replats or vacation of any such plans, plats or replats. However, the city council may by ordinance additionally required [require] approval of such plans, plats, replats or vacating of any plans, plats or replats by the city council, all of which shall be pursuant to state law.
(3) 
To promote public interest in and understanding of the planning, zoning and development of the city.
(4) 
Hold public hearings for and advise the council on such matters as the council may request its advice and on such matters as it may think desirable in the public interest.
(5) 
To recommend a comprehensive plan for the physical development of the city to the city council and such other regulations that are necessary to implement the comprehensive plan, including the subdivision rules and regulations for the city and its extraterritorial jurisdiction.
