Whoever shall, in the City, own or have in his/her possession, custody or control, any dog, cat or animal and who shall suffer or permit the same to go at large upon any public street, alley, or sidewalk, shall be deemed guilty of an ordinance violation.

No person shall own, keep or harbor any animal which, by loud, frequent or habitual barking, howling or yelping, shall annoy or disturb any neighborhood or person, or by habitually jumping upon or threatening persons upon public streets shall cause persons thereon to be put in fear or injury or habitually spreads garbage or habitually attacks other domestic animals, pets or domestic fowl.

No person shall own, or have in his/her possession, custody or control, any dog, cat or animal within the City unless such person shall first register annually said animal with the City Collector and obtain and thereafter display a license tag which must be securely attached by a collar to the neck of the animal. The City Collector shall maintain animal registration records listing the following information which the applicant must provide before each license tag issued: 1) the name and address of each person to whom a license tag is issued, 2) the name, breed, age, sex and description of each animal for which a license tag is issued, 3) the date of the animal's last rabies vaccination and 4) the amount of the license fee paid. The applicant shall provide the required information as well as proof that the animal has received its rabies vaccination and pay an annual license fee of ten dollars ($10.00) before the City Collector shall issue said license tag. In the event the animal is less than three (3) months of age and not able to safely receive a rabies vaccination, the City Collector shall issue a temporary license tag which shall expire when the animal becomes three (3) months of age at which time the applicant must present proof of the animal's rabies vaccination in order for the Collector to issue a permanent license tag.

It shall be unlawful for any person owning or in control of any animal to permit or allow such animal to defecate upon any public or private property of another, unless such person shall immediately remove all feces so deposited by such animal and dispose of the same in a sanitary manner. The provisions of this Section shall not apply to a guide dog accompanying any blind person.

There is hereby established the position of Humane Officer of East Prairie, Missouri. The duties of the Humane Officer shall be to take up any animals named in this Chapter running at large and confine them in a City pound to be hereafter established. Any animal which is so taken up by said Humane Officer which is identifiable by markings shall be kept in said City pound by said Humane Officer who shall make reasonable efforts to identify the owner or custodian thereof. All other animals not so identifiable shall be held in said City pound for a minimum of three (3) days. All animals so impounded by the City Humane Officer which are not identified or re-claimed by the owner or any other person within the time limits specified above shall be put to death in as humane a manner as possible. All said animals so impounded by the City Humane Officer shall be redeemed by the owner or other person only upon payment to said Humane Officer of the sum of ten dollars ($10.00) per day for each day said animal has been impounded.

If any person shall willfully break into or otherwise open any pen or pound and let out any animal impounded by virtue of this Chapter, or shall interfere with any officer in the discharge of his/her duties under this Chapter by taking out of his/her possession or custody, or attempting by force or otherwise to take out of his/her possession or custody, any animal or animals that may be driven by him/her for the purpose of impounding the same, such person shall be deemed guilty of an ordinance violation and, upon conviction thereof, shall be fined as set forth in Chapter 100, Article III, of this Code.

Hereafter it shall be unlawful for any chickens, turkeys, geese and ducks or other domestic fowl to be kept within the limits of the City of East Prairie, Missouri, unless the same are confined in a pen adequate to restrain said fowls from running at large. A property owner or occupant shall have no more than twelve (12) domestic fowl per lot, tract or parcel of land and shall be required to provide a minimum of fifty (50) square feet of pen space per each fowl and have an adequate structure for shelter.

No animals other than dogs and cats shall be kept or confined within the City limits of East Prairie, Missouri, unless otherwise allowed in this Chapter.

A. 
Except as otherwise provided herein, it shall be unlawful for any person to own, keep, harbor or in any way possess within the City limits of East Prairie, Missouri, any dangerous dog as hereinafter defined or described.
1. 
Leash And Muzzle. No person shall permit a dangerous dog to go outside its kennel or pen unless such dog is securely leashed with a leash no longer than four (4) feet in length. No person shall permit such dogs to be kept on a chain, rope or other type of leash outside its kennel or pen unless a person is in physical control of the leash. Such dogs may not be leashed to inanimate objects such as trees, posts, buildings, etc. In addition, all such dogs on a leash outside the animal's kennel must be muzzled by a muzzling device sufficient to prevent such dog from biting persons or other animals.
2. 
Confinement. All such dogs shall be securely confined indoors or in securely enclosed and locked pen or kennel, except when leashed and muzzled as above provided. Such pen, kennel or structure must have secure sides and a secure top attached to the sides. All structures used to confine such dogs must be combination lock when such animals are within the structure. Such structure must have a secure bottom or floor attached to the sides of the pen or the sides of the pen must be embedded in the ground no less than two (2) feet. All structures erected to house such dogs must comply with all zoning and building regulations of the City. All such structures must be adequately lighted and ventilated and kept in a clean and sanitary condition.
3. 
Confinement Indoors. No such dog may be kept on a porch, patio or in any part of a house or structure that would allow the dog to exit such building on its own volition. In addition, no such animal may be kept in a house or structure when the windows are open or when screen windows or screen doors are the only obstacle preventing the dog from exiting the structure.
4. 
Signs. All owners, keepers or harborers of such dogs within the City shall within ten (10) days of the effective date of this Section display in a prominent place on their premises a sign easily readable by the public using the words "Beware of Dog." In addition, a similar sign is required to be posted on the kennel or pen of such animal.
5. 
Insurance. All owners, keepers or harborers of such dogs must provide proof to the East Prairie City Clerk of public liability insurance in a single incident amount of fifty thousand dollars ($50,000.00) for bodily injury or death of any person or persons or for damage to property owned by any persons which may result from the ownership, keeping or maintenance of such animal. Such insurance policy shall provide that no cancellation of the policy will be made unless ten (10) days' written notice is first given to the East Prairie City Clerk.
6. 
Registration Requirements. All owners, keepers or harborers of dangerous dogs must provide to the City Clerk two (2) color photographs of the said dog clearly showing the color and approximate size of the animal. Further, they shall register the dog with the City Clerk providing the name of the dog, the address where the dog shall be maintained and execute an acknowledgment of receipt of a copy of this Article.
7. 
Reporting Requirements. All owners, keepers or harborers of dangerous dogs must within ten (10) days of the incident, report the following information in writing to the East Prairie City Clerk as required hereinafter:
a. 
The removal from the City or death of such a dog;
b. 
The birth of offspring of such a dog;
c. 
The new address of a dangerous dog owner should the owner move within the corporate City limits.
8. 
Irrebuttable Presumptions. There shall be an irrebuttable presumption that any dog registered with the City as a dangerous dog or any of those breeds prohibited by Section 205.060 of this Article is in fact a dog subject to the requirements of this Section.
9. 
Failure To Comply. It shall be unlawful for the owner, keeper or harborer of a dangerous dog as defined in this Section to fail to register that dog with the City of East Prairie as required by this Section or for such an owner, keeper or harborer of such a dog to fail to comply with the requirements and conditions set forth in this Section. Any dog found to be the subject of a violation of this Section shall be subject to immediate seizure and impoundment. In addition, failure to comply will result in the revocation of the license of such animal resulting in the immediate removal of the animal from the City.
10. 
"Dangerous dog" is defined to mean:
a. 
Any pit bull dog, Doberman pinscher or Rottweiler; or
b. 
Any dog which, according to the records of the appropriate authority, has inflicted severe injury on a human being without provocation on public or private property.
c. 
Any dog which, according to the records of the appropriate authority, has killed a domestic animal without provocation; or
d. 
Any dog owned or harbored primarily or in part for the purpose of dog fighting or any dog trained for dog fighting; or
e. 
Any dog, not owned by a governmental or law enforcement unit, used primarily to guard public or private property; or
f. 
Any dog with a known propensity, tendency or disposition to attack unprovoked, to cause injury, or to otherwise threaten the safety of human beings or domestic animals; or
g. 
Any dog which, when unprovoked, chases or approaches a person upon the streets, sidewalks or any public or private property in a menacing fashion or apparent attitude of attack; or
h. 
Any dog which, on three (3) separate occasions within a twelve-month period has been observed being unrestrained or uncontrolled off its owner's premises by animal control or wildlife authority or has been impounded by appropriate authority for being unrestrained or uncontrolled off its owner's premises.

Any person who violates the provisions of this Article, upon conviction, shall be deemed guilty of an ordinance violation punishable by a fine and/or imprisonment as set forth in Chapter 100, Article III, of this Code. In addition, the court shall order the registration of any dangerous dog to be revoked and order the defendant to immediately remove such dog from the City limits. In the event the defendant fails or refuses to remove said dog from the City limits, the municipal court judge shall find the defendant in contempt of the court and order the City Humane Officer or Police Department to immediately confiscate and impound said animal and thereafter follow the procedures set forth in Section 205.030 above. Each day that a violation of this Chapter continues shall be deemed a separate offense. In addition to the foregoing penalties, any person who violates this Chapter shall be responsible for and pay all expenses incurred by the City for the care of the animal, including the cost of shelter, food, handling, veterinary care, expert witness fees and other testimony necessitated by the enforcement of this Chapter.
