The purpose of the Downtown Hutto Incentive Program ( the "Program") is to encourage quality renovations of and improvements to existing historic buildings and properties that contribute to the longevity, preservation, and economic vitality of the City's Historic Downtown. Improvements of significance that qualify for incentives under this Program are declared to promote economic development and serve a valid public purpose of the City.

(a) 
The Program may include one or more incentive structures as authorized by Texas Local Government Code, Chapter 380, and other applicable state law, including, but not limited to:
(1) 
Property tax reimbursement programs;
(2) 
Sales tax reimbursement programs;
(3) 
Property tax freeze programs;
(4) 
Facade improvement reimbursement grants;
(5) 
Development inspections and permitting fee reimbursement; and
(6) 
Other performance-based incentives approved by the City Council.
(b) 
Incentives awarded under the Program shall be subject to the execution of a written agreement between the City and the participating property owner or business, as applicable, and shall comply with all legal requirements for public purpose, performance, and accountability.

(a) 
Chapter 380 economic development agreements, or other applicable performance-based incentive agreements, shall serve as the primary contractual mechanism for incentives awarded under this Program.
(b) 
The City Manager or the City Manager's designee is authorized to administer the Program, accept and review applications, negotiate proposed incentive agreements consistent with adopted policies, and execute agreements as authorized by the City Council.
(c) 
Incentive agreements requiring City Council approval by law or City policy shall not become effective unless approved by the City Council in an open meeting.

(a) 
The specific eligibility criteria, application procedures, incentive types and amounts, performance standards, reporting requirements, geographic boundaries, and other operational details of the Program shall be established in one or more written policies adopted by resolution of the City Council.
(b) 
Program policies may be amended from time to time by resolution passed by a majority vote of the City Council at a duly posted City Council meeting.
(c) 
All adopted policies and amendments shall be maintained by the City Secretary and made available for public inspection.
