For the purpose of this article, the following definitions shall apply, unless the context clearly indicates or requires a different meaning:
Alcoholic beverage.
Alcohol and any beverage containing more than 0.5% of alcohol by volume which is capable of use for beverage purposes, either alone or when diluted.
Amplified sound.
Any sound projected or transmitted by artificial means, including but not limited to amplifiers, loudspeakers or any similar device.
Department.
The city department of parks and recreation.
Person.
Any person, firm, partnership, association, corporation, company or organization of any kind.
Public display or exhibition of beer, wine or liquor.
The carrying, possession, or exhibiting of open cans, bottles, glasses, or any other container of beer, wine, or liquor, even though appearing empty, on or within any public park as defined herein or within any vehicle that is upon a public park as defined herein. This definition does not include carrying or transporting beer, wine or liquor from retail or wholesale liquor or beer establishments in sacks, cases, boxes, cartons or other similar containers if the seal for the alcoholic beverage container is unbroken; nor does this definition include those situations wherein the alcoholic beverage container is being transported or carried to a recycling center or garbage disposal site; nor does this definition include transportation of alcoholic containers in a compartment of a vehicle that is outside the passenger area of the vehicle and which is not accessible to the driver and passenger of the vehicle from the passenger area while the vehicle is in operation.
Public park/city park.
Any land, and any building or facility thereon, designated, used, owned, obtained, or acquired by the city used for the following purposes: public park, recreation, sports, fishing, picnicking, golf, baseball, basketball, football, swimming, boating, disc golf, playground, and any other park and recreation type activities, whether or not such areas have been formally dedicated to such purpose.
Supervisor.
The person designated as and occupying the position of supervisor of the department of parks and recreation.
Vessel.
Includes any device of human conveyance on the water, whether propelled by motor, wind, or human power. The term includes but is not limited to any boat, yacht, cruiser, canoe, raft, or other watercraft.

Within the limits of any public park, it shall be unlawful for any person or persons to do any of the acts hereinafter specified, except as may be otherwise provided:
(1) 
Hitch, fasten, lead, ride, drive or let lose any animal or fowl of any kind; provided that this shall not apply to dogs when led by a cord or chain not more than six feet long.
(2) 
Operate or use any bicycle, motorcycle, motor scooter or any other vehicle in and upon the public parks of the city, save in certain areas, drives and pathways specifically designated or authorized for such purpose.
(3) 
Carry or discharge any firearm, air gun or slingshot, or rocket, torpedo, or any other firework.
(4) 
Damage, cut, break, injure, deface, disturb, displace, or remove any natural or human-made properties within a public park.
(5) 
Cut or remove any wood, turf, grass, soil, rock, sand, gravel, mulch, or fertilizer.
(6) 
Leave garbage, cans, bottles, papers or other litter or refuse elsewhere than in receptacles provided therefor.
(7) 
Overnight camping is prohibited unless a permit is obtained. Exceptions may be granted by the supervisor of the parks and recreation department in accordance with this article.
(8) 
For any person to consume or have in his or her possession any alcoholic beverage without a special use permit issued by the city manager or his/her designated official to: (i) a private individual or organization, or (ii) an organization(s) sponsoring a community event that involves neighborhood-wide or community-wide impact.
(A) 
The special use permit will require a security deposit and permit fee in accordance with the fee schedule in appendix A of this code.
(B) 
The special use permit may restrict consumption of alcoholic beverages to specific areas within the boundaries of the park(s) and may require security for public or private events when attendance is estimated to be over 200 persons.
(9) 
Operate a motor vehicle at any time without a muffler in good working order, or to operate a motor vehicle in such a manner as to create excessive or unusual noise, or to use a muffler cut-out, bypass, or similar device.
(10) 
Park vehicles or trailers upon the grass, lawn, or anywhere else within a park, other than in those areas designated for that purpose.
(11) 
Park vehicles or trailers anywhere but within and between the visible lines designating a single vehicle parking space of any parking lot of the city parks when such visible parking space lines have been placed upon such parking lots.
(12) 
Park any vehicle or trailer in any parking lot or parking area so as to obstruct, block or hinder ingress or egress of such parking lot or parking area.
(13) 
Play or bet at or against any game which is played, conducted, dealt, or carried on with cards, dice or other device, for money, chips, shells, credit or any other representative of value, or to maintain or exhibit any gambling table or other instrument of gambling or gaming.
(14) 
Distribute, post, place or erect any advertising, handbill, circular, bill, notice, paper, or other advertising device.
(15) 
Practice, carry on, conduct or solicit for any trade, occupation, business or profession unless such person has obtained a permit from the supervisor of the parks and recreation department in accordance with this article.
(16) 
Swim, bathe or wade in any water or waterway in any park except in such water or waterway as may be designated for such purpose.
(17) 
Operate or use any vessel in any water or waterway except where the water or waterway is specifically designated for that purpose.
(18) 
Start or maintain any outdoor fire except for cooking fires, which shall be started and maintained only in a stove, fireplace, barbecue pit or portable camp stove.
(19) 
Leave a started fire unattended without first completely extinguishing the fire.
(20) 
Operate any motor vehicle on any designated hike, bike and equestrian trail within the city limits, except certain motor vehicles shall be exempt from this subsection (20), including emergency vehicles and motor vehicles used in the maintenance of such hike, bike and equestrian trails.

City parks will have the following operating hours. Anyone wishing to participate in any activity within a park outside operating [hours] must obtain a permit from the parks and recreation department.
(1) 
Twin Lakes: From 6:00 a.m. until 12:00 a.m. (midnight).
(A) 
Exceptions include anyone camping or fishing at Lake Jacksboro or Lost Creek Reservoir, or any permitted event.
(2) 
Neighborhood parks: Sunday through Thursday from 8:00 a.m. until 10:00 p.m., and Friday through Saturday 8:00 a.m. until 11:00 p.m.
(3) 
Sewell Park: Sunday through Thursday from 8:00 a.m. until 10:00 p.m., and Friday through Saturday 8:00 a.m. until 11:00 p.m.

A sign will be erected at all city parks as herein defined, for the purpose of giving notice to the general public that it is a city park.
