(a)
A person commits an offense if the person disposes of junk, garbage, rubbish, refuse, or other solid waste on a public highway, street, right-of-way, public park, or into another person's residential or commercial container or polycart, or on other public or private property within the boundary limits of the city.
(b)
A person commits an offense if the person allows or permits another person to dispose of junk, garbage, rubbish, refuse, or other solid waste on a public highway, street, right-of-way, public park, or into another person's residential or commercial container or polycart, or on other public or private property within the boundary limits of the city.
(c)
It is a defense to prosecution under this section that the disposal occurred at a permitted or licensed solid waste site provided for public use, or a designated collection area provided for public use for ultimate disposal at a permitted or licensed solid waste site.
(d)
It is a defense to prosecution under this section that the disposal into another person's residential or commercial container or polycart was done in a manner such that the amount disposed was no more than a handful, was an insignificant amount and was done to prevent littering or to dispose of another person's litter.
