(a) A person commits an offense if the person disposes of junk, garbage,
rubbish, refuse, or other solid waste on a public highway, street,
right-of-way, public park, or into another person's residential or
commercial container or polycart, or on other public or private property
within the boundary limits of the city.
(b) A person commits an offense if the person allows or permits another
person to dispose of junk, garbage, rubbish, refuse, or other solid
waste on a public highway, street, right-of-way, public park, or into
another person's residential or commercial container or polycart,
or on other public or private property within the boundary limits
of the city.
(c) It is a defense to prosecution under this section that the disposal
occurred at a permitted or licensed solid waste site provided for
public use, or a designated collection area provided for public use
for ultimate disposal at a permitted or licensed solid waste site.
(d) It is a defense to prosecution under this section that the disposal
into another person's residential or commercial container or polycart
was done in a manner such that the amount disposed was no more than
a handful, was an insignificant amount and was done to prevent littering
or to dispose of another person's litter.

The following special requirements and prohibitions shall govern
the collection of the types of refuse indicated:
(1) Garbage and household trash.
Such refuse shall be placed in regulation containers as specified in section
12.03.032, and collected from the normal collection point as specified by the code enforcement officer.
(2) Tree limbs, shrubs, hedge cuttings, grass and leaves.
Such refuse shall be collected on normal collection days if such
material is tied and bundled in four-foot lengths, or bagged and not
exceeding 40 pounds. Such material shall be placed at the curb on
regularly scheduled collection days.
(3) Brush, trees, bulky items and household appliances.
Such refuse shall be reduced to shapes and sizes not over four feet
in length and tied in bundles that can be readily handled by collectors,
and placed at the point specified by the code enforcement officer.
Bulky items and household appliances shall be collected on the first
Wednesday of each month. All household appliances must be free of
freon and properly tagged by licensed freon recovery personnel. The
customer must contact the solid waste contractor at least 48 hours
prior to collection.
(4) Ashes.
All ashes must be allowed to stand until cold
before being placed in containers for collection. Ashes which have
been allowed to cool completely shall be placed in suitable containers
and will be collected from the point specified by the code enforcement
officer.
(5) Earth and construction materials.
Earth, rocks, concrete
and similar materials will not be collected during normal collections.
Waste materials resulting from construction or remodeling and materials
from an unimproved lot will not be normally collected. Appropriate
containers must be provided for the collection and disposal of such
materials.
(6) Wet refuse.
All refuse that is mixed with water or other
liquids shall be drained before being deposited in the garbage container.
(7) Animal excrement.
All animal excrement shall be wrapped
in paper or other combustible material before being deposited in the
garbage container.
(8) Paper.
Where large accumulations of paper, such as newspapers,
are put out for collection, such papers shall be securely bound or
placed in containers, to prevent scattering of paper on privately
and publicly owned premises.
(9) Weight.
The combined weight of the garbage and the container
shall not exceed 75 pounds regardless of the contents thereof.

Any person, firm or corporation desiring to dispose of refuse
from their own premises at a city operated disposal site may do so,
provided such refuse is dumped at the place designated by the person
in charge of the disposal site.

All individuals or organizations shall use covered containers
in the transportation of items of refuse to the city sanitary landfill.
These items shall be covered or secured in such manner as to prevent
the scattering of any debris.

The disposal or burning of kitchen garbage, trash or rubbish
in any place within the city limits is prohibited except by persons
or business operators dealing in papers of a personal or secret nature
which requires that they be destroyed in the presence of the persons
owning or holding same, which persons or businesses shall on proper
satisfactory showing to the city obtain special permits for this purpose.

All junk and other material placed upon the dump ground by any
person, firm or corporation becomes the property of the city and no
person is allowed to separate and collect, carry off or dispose of
same except under the direction of the city.

Various types of waste shall be disposed of as follows:
(1) Garbage.
Garbage shall be placed in containers or roll-outs.
(2) Yard trash.
Yard trash shall be placed in containers
if containers are available. Where roll-outs are used, yard trash
shall be bagged and placed by the curb for collection with brush.
(3) Brush.
Brush shall be placed in the alley in such a
way as not to obstruct traffic or interfere with the emptying of containers
where alleys exist. Where alleys do not exist, brush shall be placed
at the street behind the curb.
(4) Construction debris.
Construction debris will not be
removed by the city or its agents. Construction debris shall be removed
by the owner or occupant of the premises or his or her agent.
(5) Bulk waste.
Bulk waste will not be removed by the city
or its agents. Bulk waste shall be removed by the owner or occupant
of the premises or his or her agent.

Small dead animals may, at the expense of the owner, be disposed
of by the animal control officer. Heavy dead animals such as horses
and cattle must be disposed of by the owner or person having charge
of any such animal, at his or her own expense, in the manner and by
the method specified by the health officer of the city.

(a) The convenience station shall not accept tires, batteries, dead animals,
brush which cannot be chipped, shingles, rock, soil, concrete, metal,
barrels, hazardous waste of any kind and hot ashes or burning material.
(b) Metal items and household appliances shall be separated and placed
in designated areas. Items containing freon will not be accepted without
proper tagging indicating freon has been removed by licensed freon
recovery personnel.
