The City Council hereby approves and adopts the Water Conservation Plan, including emergency water demand measures, ordinances, resolutions, and exhibits, the text of which is on file at Whitehouse City Hall and available for public inspection, as updated by the city, previously submitted to the Texas Water Development Board and available for inspection at these Council meetings at which it is adopted. The city shall implement and enforce the program and will submit all necessary reports to the Texas Water Development Board.

The above referenced Water Conservation Plan shall be made available for public inspection the City Hall on a permanent basis and shall be plainly labeled as being the plan adopted by the city.

The Operator of Public Utilities shall be responsible for the implementation of the program, particularly including drought contingency measures. In the event that measures requiring separate action by the City Council are found necessary, the Operator of Public Utilities shall be responsible for requesting a special or emergency Council meeting if necessary, and for presenting the matter to the Council for action.

(A) 
Any corporation, firm, agent, or person violating any of the provisions of secs. 51.10 through 51.22 of this chapter shall be subject to the penalty provisions of sec. 10.99 of this code.
(B) 
Persons in violation of secs. 51.35 through 51.37 of this chapter shall be subject to one or more of the following penalties, as specified in the separate ordinances included in the Water Conservation Program:
(1) 
Having a flow restricter placed on the violator’s water service line at that person’s expense;
(2) 
Disconnection of any or all water and/or sanitary sewer services provided to the violator by the city;
(3) 
Withholding of water and/or sanitary sewer service to newly constructed facilities; and
(4) 
A fine not to exceed $200 per day per violation.
(C) 
In the event water service is resumed in violation of sec. 51.01 of this chapter, water service to the property may be discontinued by the city until the required charges, plus an additional charge of $25 are paid to the city.
