To the extent permitted by applicable
law, it is hereby required that all properties now or hereafter situated
in the city shall connect onto and be served by the city’s waterworks
and sewer system as and when services from said system become available
thereto.

(a)
The term “public utility”
is defined by section 13.002 of the Texas Water Code (2013) and the
term “industrial district” is defined by section 42.044
of the Local Government Code (2013).
(b)
All fire hydrants of a public utility
located in a residential area or an industrial district within the
city or its ETJ must provide, in addition to the public utility’s
maximum daily demand, fire flow from its fire hydrants of 250 gallons
per minute for at least two hours and water pressure of 20 pounds
per square inch so long as the fire flow from city-owned fire hydrants
meet or exceed these requirements and provided that existing fire
hydrants of the public utility meet these requirements as of the effective
date of this section.
(c)
All fire hydrants installed by a
public utility after the effective date herein must meet the fire
flow requirements of this section.
(d)
All fire hydrants acquired by a public
utility as part of the acquisition of all or a portion of a public
water system must meet the fire flow requirements of this section
provided that the requirements were satisfied at the time of the hydrants
were acquired.
(e)
All fire hydrants of a public utility
subject to this section as of the effective date shall be painted
red no later than December 1, 2013.
(f)
A person who violates a provision
of this section is guilty of a misdemeanor which is punishable by
a fine not to exceed $2,000.00. Each occurrence of a violation, or,
in the case of continuous violations, each day a violation occurs
or continues, constitutes a separate offense and may be punished separately.
(g)
The city manager is instructed, on
behalf of the city, to encourage emergency services district No. 8
of the county to enter into a memorandum of understanding with any
public utility affected by this section. The focus of the memorandum
will he on working out protocols for the testing of meters for compliance
with this section and for the reporting of water usage during testing
or responding to fire emergencies.
