Commercial handbill.
Any printed or written matter, or any sample, device, circular, leaflet, pamphlet, paper, booklet or similar item, which directly or indirectly advertises or offers for sale or rent, for the purpose of private gain or profit, any merchandise, product, commodity, service or thing of value. A newspaper having more than forty (40) percent news or editorial comment is not a commercial handbill.
Noncommercial handbill.
Any printed or written matter, or any sample, device, circular, leaflet, pamphlet, paper, booklet or similar item, which is not a commercial handbill.
Public place.
Any and all streets, sidewalks, boulevards, alleys or other public ways and any and all public parks, squares, spaces, grounds, lakes, streams and buildings.

A person commits an offense if he places or posts on public property a sign or handbill. The chief of police of the city is hereby authorized to remove and dispose of such signs or handbills.

No person shall throw or deposit any commercial or noncommercial handbill in or upon any sidewalk, street, or other public place in the city, nor shall any person hand out or distribute any handbill in such a manner as to obstruct or impede the free and direct passage of other persons thereon or create any traffic hazard thereat.
No person shall throw, deposit or distribute any handbill in or upon private premises:
(1) 
If requested by any person thereon not to do so;
(2) 
If there is placed on such premises in a conspicuous position upon or near the entrance thereof a weather-proof sign, not less than three inches (3") by four inches (4") in size, containing the words “No Solicitors” or any similar notice indicating in any manner that the occupants of such premises do not wish to have such handbills left upon their premises; or
(3) 
In such a manner that the handbill may be dislodged by wind onto the premises or other private premises, or onto sidewalks, streets or other public places.
