The accumulation of refuse, trash, garbage, and waste on the premises of private residences, businesses, public and private institutions, vacant lots and in the streets and alleys of the city, constitutes a public menace and nuisance and greatly increases the danger of the spread of infectious, contagious, and epidemic diseases. The regulations in this article are adopted for the purpose of preserving and protecting public health, safety, and general welfare by requiring property owners, tenants, occupants, and lessees to secure and maintain containers and receptacles of sufficient size and material for the deposit of refuse, trash, garbage, and waste for collection and removal at regular intervals. It shall be compulsory for each unit attached to city utilities to pay the curbside pickup charges as provided herein. Units paying for the use of a dumpster or roll-out carts and unoccupied homes, where all residents are in an extended care facility, shall be exempt from the curbside pickup charge.

Commercial Waste.
Waste relating to commerce or a business.
Construction or Demolition Wastes.
Wastes that are generated as a result of construction or demolition of structures.
Garbage.
As all waste animal or vegetable or inert matter, such as, but not limited to, waste, material and refuse from residences, dwellings, mobile homes, apartments or other places of abode.
Recyclable Materials.
Materials specified by the city for collection in accordance with recycling regulations.
Recycling.
The separation, collection, processing, recovering and sales or reuse of materials, glass, paper, plastics, used oil, tires, batteries and other materials which would otherwise be disposed of as solid waste.
Refuse.
Waste, rubbish, or any material of any kind that has been discarded, rejected, cast aside or thrown away as worthless, including, but not limited to, metal cans, bottles, plastic substances, rubber substances, metal substances and glass.
Residence.
Any house, apartment, mobile home or other dwelling occupied by a family, person or domestic animal that generates solid waste to be collected individually.
Residential Waste.
Waste relating to a dwelling where a person lives.
Trash.
Rubbish, paper of all kinds, rags old clothing, feathers, ashes, paper containers, old rubber objects, pieces of wood, boxes, barrels, crates, yard cleaning, yard wastes, leaves, brush, and tree trimmings.
Waste.
All putrid and non-putrid discarded or unwanted material resulting from or incidental to residential occupancy or commercial activity.
Yard Waste.
Materials related to yard maintenance; same including but not limited to, grass clippings, brush/shrub clippings, tree trimmings, branches and other materials that can be contained, handled and composted; such tree trimmings that can be chipped by the city chipper.

It shall be unlawful for any person, association of persons, firm, or corporation to burn refuse, trash, garbage or waste within the city limits.

(a) 
Any waste to be collected by city crews, or city contractor, that is not designated residential waste shall be deemed commercial waste. Commercial waste shall be contained in a designated approved container. The types of approved container that may be used by commercial customer are:
(1) 
Designated roll-out carts furnished by the city, or city contractor, upon request (96 gallon); or
(2) 
Dumpster containers (2, 3, 4, 6, and 8 cu. yd.) furnished by the city, or city contractor, upon request. Any single type of approved container may be used or any combination of approved containers may be used by commercial customers.
(b) 
Residential waste shall be collected by the city crews, or city contractor, on a regular schedule to be established by the city. Waste shall be bagged and placed in the designated roll out cart furnished by the city or city contractor and set in an open area, curbside or street-side at the residence of the landowner or occupant of the premises.
(c) 
A schedule of rates is hereby adopted as provided for in the fee schedule found in the appendix of this code.

(a) 
If any person, firm or corporation shall violate any of the provisions of this article, they shall be guilty of a misdemeanor, and upon conviction in the municipal court, shall be punished by a fine in accordance with the general penalty provision found in Section 1.106 of this code. Each day of such violation shall be deemed a separate offense.
(b) 
Any person violating any of the provisions of this article shall become liable to the city for any expense, loss or damage occasioned by the city by reason of such violation.

The city shall provide curbside or street-side limb chipping to the citizens of the city (within corporate limits). Such limbs are to be cut in lengths easily removed individually form the stack. Small twigs may be placed in the designated roll out carts or dumpster containers. Collection thereof may be requested by the citizens. Charges for this service shall be as provided for in the fee schedule found in appendix A of this code.

(a) 
Trash and Construction/Demolition Waste.
The city shall furnish a container in which individuals may bring and dispose of trash including, but not limited to appliances, refuse, and construction/demolition waste. The cost to be paid by such individual for disposal of such matter shall be determined by the city council, as reflected in the fee schedule found in the appendix of this code.
(b) 
Disposal of Residential Waste.
The city shall provide a container in which individuals may bring and dispose of residential waste. The cost of such disposal shall be determined by the city council. Disposal rates for household garbage are as reflected in the fee schedule found in the appendix of this code.
(c) 
Recycling.
The city shall provide a location and container for individuals to bring and place segregated recyclable materials. Such materials shall be placed in these containers as approved by the city of which is able to dispose thereof by recycling.

Responsibility for the property preparation for disposable waste shall be upon the individual generating the waste. No waste or refuse shall be presented for disposal except in approved containers and none shall be placed individually outside of or within unapproved containers.
