(j) 
Adjustment of sewer charges exceeding a single month's average consumption caused by a leak or broken water pipe between the city's water meter and the structure:
(1) 
Customer shall complete a form requesting adjustment and verify that repairs were made promptly after a leak was first identified.
(2) 
Customer's sewer charge shall be adjusted for one billing period.
(3) 
The adjusted charge shall be equal to the sewer charge for the same billing period in the previous year.
(4) 
City has the right for a representative to access customer's property to determine the leak was repaired and that water from the leak did not enter the city's sanitary sewer.
(k) 
Adjustment of sewer charges for the filling of swimming pools exceeding 7,500 gallons.
(1) 
Customer shall submit time and date stamped pictures of the pool empty and filled, documented proof of the capacity of the pool from the manufacturer or builder, and date and time fill started and completed, to utilitybilling@cityofhallettsville.org.
(2) 
The adjustment shall be equal to the capacity of the pool or the amount of water pumped during the time period stated to fill the pool, whichever is less.
(3) 
City has the right for a representative to coordinate viewing access of the pool if needed.

(k) 
Any person, firm, partnership, or corporation or other business entity purchasing water from the city for direct resale shall be an interruptible customer. In the event that the water level becomes substandard or low and/or pressure is low, or in the event of an emergency requiring extraordinary use of the water of the city, the city shall cut off without notice such service to the purchaser hereinabove provided.

(a) 
Residential Subscribers.
Upon application, each subscriber shall sign an agreement providing for a security deposit for electrical and water services; refundable without interest, upon subscriber's request, after 18 months of prompt payment with no delinquencies for utility services or after deduction of all utility charges at termination of service.
(1) 
In lieu of a residential security deposit the city may accept a signed agreement attesting the service is for the homeowner who resides in the house.
(A) 
Homeowner means the owner-occupant of a parcel located within the city who is listed as the owner by the county central appraisal district.
(B) 
A homeowner applying for utilities before the county central appraisal district's records are updated, may submit a stamped and/or recorded deed as proof of ownership.
(2) 
In lieu of a residential security deposit, the city may accept letters of credit from electricity providers showing subscriber had no late payments for the past eighteen (18) months.
(b) 
Small Commercial/Nonresidential Subscribers.
Upon application, each small commercial/nonresidential subscriber shall sign an agreement providing for a security deposit for electrical and water services; refundable without interest, upon subscriber's request, after 36 months of prompt payment with no delinquencies for utility services or after deduction of all utility charges at termination of service. In lieu of a security deposit:
(1) 
In lieu of a security deposit the city may accept one of the following:
(A) 
A signed agreement attesting the service is for the building owned by the applicant and a letter of credit from an electric utility for the subscribers business showing no late payments for the past eighteen (18) months.
(B) 
A thirty-six-month bank letter of credit in the amount of the security deposit.
(C) 
A thirty-six-month certificate of deposit payable to the city with interest paid to the subscriber.
(D) 
A small nonresidential subscriber, for electricity, uses less than 5,000 kWh per month.
(E) 
A small nonresidential subscriber, for water, is connected to a 1" or smaller meter.
(c) 
Large Commercial Nonresidential Subscribers.
Upon application, each large commercial/nonresidential subscriber shall sign an agreement providing for a security deposit for electrical and water services equal to two (2) months' usage based on past consumption of service, comparable user (current or past), or as deemed appropriate by council. Deposit shall be refunded without interest, upon subscriber's request, after 36 months of prompt payment with no delinquent utility bills or after deduction of all utility charges at termination of service. In lieu of a security deposit:
(1) 
In lieu of a security deposit the city may accept one of the following:
(A) 
A signed agreement attesting the service is for the building owned by the applicant and a letter of credit from an electric utility for the subscribers business showing no late payments for the past eighteen (18) months.
(B) 
A thirty-six-month bank letter of credit in the amount of the security deposit.
(C) 
A thirty-six-month certificate of deposit payable to the city with interest paid to the subscriber.
(D) 
A large commercial/nonresidential subscriber, for electricity, uses more than 5,000 kWh per month.
(E) 
A large nonresidential subscriber, for water, is connected to a 1-1/2" or larger meter.
(d) 
In lieu of a security deposit for up to three additional meters of the same classification, the city may accept a signed agreement attesting the ownership of the residential, small or large commercial/nonresidential subscriber has been a city utility customer for the past thirty-six (36) months and is in good credit standing with no late payments for the past eighteen (18) months.

(a) 
The utility bill shall be due and payable on the 10th day of each month; unless however the 10th day falls on any city or postal holiday or weekend, the due day will be extended to the next postal and city working day.
(b) 
Failure to make timely payment shall incur a 10% penalty with a minimum charge of $5.00 therefor.
(c) 
Notices of delinquencies will be given on the 11th day of the month and services shall be discontinued and disconnected on the 18th day of the month; unless however the due date falls on any postal holiday, the due date will be extended an extra day to cover such holiday. On or after the 18th, a late fee of $40.00 in addition to payment of all delinquencies must be paid before services will continue or be reconnected. Seven days notice shall be given of the anticipated action to terminate upon default in payment.
(d) 
Upon applying for service, each applicant shall sign an agreement relating to security deposit as hereinabove in this article outlined and further agreeing that upon the 18th day of the month that such services will be terminated. Further, a written agreement shall be secured upon application for service, waiving any cause of action against the City of Hallettsville, Texas, for terminating such services.
(e) 
A service charge of each check or draft returned to the city marked “Insufficient Funds” of “Account Closed” shall be the sum of $25.00 to be paid by the subscriber issuing such check or draft.

Delinquencies.
Service will be disconnected on the 18th day of the month. On or after the 18th, a fee of $50.00 in addition to payment of all delinquencies must be paid before services will continue or be reconnected. Seven days' notice will be given of this anticipated action.
(e) 
Service Outside of City Limits.
Add 15% on the connection, base monthly charge and wires charge.
(f) 
Electric Rate - Residential.
Single-family residential customers for all domestic usage.
(1) 
Base monthly charge: $15.38 per meter.
(2) 
Generation charge:
(A) 
Generation charge includes all fuel charges from supplier.
(B) 
The city administrator shall adjust the generation charge monthly to equal the total cost of generation supplied to the city.
(3) 
Wires charge: $0.0559/kWh.
(A)

Before qualifying for hi load factor rate customer shall pay for twelve months of additional metering services. If customer qualifies for hi load factor rate, wires charges the previous twelve months of use will be adjusted to the hi load factor rate.

(l) 
Ball Field Lighting.
(1) 
Lighting at the four (4) little league fields is metered and billed to Hallettsville Little League.
(2) 
Others wishing to utilize the lighting at the little league fields will be billed as follows:
(A) 
Base fee: $5.00.
(B) 
Per hour: $12.50.
(3) 
Per-hour fees billed to other lighting users will be credited to Hallettsville Little League.

Any utility customer requesting a gas inspection outside of the building permit process shall be charged a fee of $80.00.
