There shall be a Municipal Clerk appointed by the Governing
Body. The term of office of the Clerk shall be three (3) years which
shall run from the actual date on which the Clerk was appointed.

No person shall be appointed as Municipal Clerk unless he shall
have a Registered Municipal Clerk Certificate issued pursuant to N.J.S.A.
40A:9-133 et seq.

The Municipal Clerk's salary shall be established in the Salary
Ordinance.

Should the office of Municipal Clerk become vacant, the Governing
Body may appoint a person to serve as Acting Municipal Clerk for a
period of not more than one (1) year and commencing on the date of
the vacancy. Reappointment to the position of Acting Municipal Clerk
shall comply with the N.J.S.A. 40A:9-133.

The Municipal Clerk shall:
a. Act as
secretary of the municipal corporation and custodian of the municipal
seal and of all minutes, books, deeds, bonds, contracts, and archival
records of the municipal corporation. The Governing Body may, however,
provide by ordinance that any other specific officer shall have custody
of any specific other class of record;
b. Act as
secretary to the Governing Body, prepare meeting agendas at the discretion
of the Governing Body, be present at all meetings of the Governing
Body, keep a journal of the proceedings of every meeting, retain the
original copies of all ordinances and resolutions, and record the
minutes of every meeting;
c. Serve as
the chief administrative officer in all elections held in the Borough,
subject to the requirements of Title 19 of the New Jersey Statutes
Annotated;
d. Serve as
the chief registrar of voters held in the Borough, subject to the
requirements of Title 19 of the New Jersey Statutes Annotated;
e. Serve as
the administrative officer responsible for the acceptance of applications
for licenses and permits and the issuance of licenses and permits,
except where Statute or ordinance has delegated that responsibility
to some other Borough officer;
f. Serve as
coordinator and records manager responsible for implementing local
archives and records retention programs as mandated pursuant to Title
47 of the New Jersey Statutes Annotated;
g. Perform
such other duties as are now or hereafter imposed by Statute, regulation
or by ordinance or regulation.

a. Creation of Position. There is created the position of Deputy
Municipal Clerk, to be appointed by the Governing Body for a term
of one (1) year, commencing January 1 annually and ending on December
31, or until a successor is appointed. Should the office become vacant
during any term it shall be filled by similar appointment for the
unexpired term.
b. Duties. The Deputy Municipal Clerk shall perform the duties
of the Municipal Clerk in the absence or disability of the Clerk.
At all other times the Deputy Clerk shall act as the assistant to
the Municipal Clerk and be under the control and charge of the Municipal
Clerk and shall perform such other duties and functions as are required
by this office or the Governing Body.
c. Salary. The salary of the Deputy Clerk shall be as set forth
in the Salary Ordinance of the Borough. Notwithstanding that the Deputy
Clerk may act in the capacity of the Municipal Clerk for any extended
period of time as permitted by law, he shall not by such reason be
entitled to an increase in salary other than set forth in the salary
ordinance.

There is hereby created the position of Municipal Administrator
to administer the business affairs of the Borough of Lakehurst, to
have such powers and perform such duties as hereinafter set forth,
and with the exception of those required by law, to be exercised by
the Governing Body or by another officer, board or body.

The Administrator shall be appointed by majority vote of the
Governing Body. The term of office shall be at the pleasure of the
Governing Body. The Administrator shall be chosen solely on the basis
of his executive and administrative qualifications with special reference
to his actual training and experience in governmental affairs and
education.

The Administrator may be removed by a two-thirds (2/3) vote
of the Governing Body. The resolution of removal shall become effective
three (3) months after adoption by the Governing Body. The Governing
Body may provide that the resolution shall have immediate effect;
provided that the Administrator shall be paid any unpaid balance of
his salary and his salary for the next three (3) months according
to law.

The salary of the Administrator shall be as set forth in the
Salary Ordinance of the Borough.

The Administrator shall provide liaison between the Governing
Body and the various departments, officers, employees, and agents
of the Borough and assist the Governing Body in the administration
of the business of the Borough and, in addition, perform the following
duties:
a. Preside
over the administration of all departments, officers, employees, and
agents of the Borough.
b. Coordinate
the finances, the compilation, and analysis of budget costs and estimates;
the maintenance of sound personnel policies and administrative practices;
and the purchase of materials, services, supplies, and equipment to
be furnished and work and labor to be performed for the Borough.
c. Coordinate
the preparation of the budget, providing to the Governing Body for
consideration within the time restraints of statutory requirements.
d. Attend
all meetings as directed and authorized by the Governing Body and
perform such other duties as the Governing Body may prescribe.
e. Recommend,
implement, and enforce the procedures and policies of the Governing
Body for the coordination, compilation, edition, and prompt dissemination
and release of public information.
f. Recommend
to the Governing Body adoption of such measures as he may deem necessary
or expedient for the health, safety, or welfare of the community or
for the improvement of services of the Borough, and shall recommend
the nature and location of public improvements authorized by the Governing
Body.
g. Prescribe
and enforce rules and regulations for the efficient management of
Borough government, subject to approval by the Governing Body and
ordinances of the Borough.
h. Recommend,
consolidate, or combine offices, positions, departments, or units
under his jurisdiction for the approval of the Governing Body and
be the head of one or more departments if in the best interests of
the Borough as determined by the Governing Body.
i. Negotiate
contracts for the Borough as authorized by and subject to the approval
of the Governing Body. He shall insure that all terms and conditions
favorable to the Borough in any statute or contract are faithfully
kept and performed, and, upon knowledge of any violation, shall call
the same to the attention of the Governing Body.
j. Perform
such other duties as may be required by the Governing Body, consistent
with the laws of the State of New Jersey or the Borough.

During the absence of the Administrator, the Governing Body
may, by resolution, appoint an officer or other employee of the municipality
to perform the duties of the Administrator as Acting Administrator
during such absence or disability. The Governing Body shall determine
when such absence or disability warrants any such temporary replacement
action.

There is hereby established the position of Borough Attorney
pursuant to N.J.S.A. 40A:9-139. The Borough Attorney shall be appointed
by the Governing Body and shall serve for a one-year term of office.

To be appointed to the position of Borough Attorney, an individual
must be an attorney-at-law of New Jersey in good standing. Additionally,
the person shall have a minimum of two (2) years experience in the
practice of municipal law.

Under direction provides legal advice and assistance to the
Governing Body and administrative staff. Acts as the agent of the
Governing Body in the legal services required and necessary for the
daily operation of the Borough. Attends and participates in all regular,
special and emergency meetings of the Governing Body and/or redevelopment
agency. Prepares and reviews ordinances and resolutions as directed,
advises the Governing Body and administrative officers on legal issues
of personnel and labor matters. A copy of the full job description
is on file in the Office of the Municipal Clerk.

Whenever deemed to be in the interest of the Borough, the Municipal
Attorney, pursuant to Loigman v. Middletown et al. 409 N.J. Super.
1,975 A.2d 999, with the approval of the Governing Body may serve
as special counsel when such service is beyond the scope of the position
of Municipal Attorney as described in this section. Such appointment,
as applicable, shall be in accordance with the provisions of a resolution
for a professional legal services contract designating such legal
services as beyond the scope of the salaried position, the hourly
rate to be incurred and a "not to exceed" amount for the total work.
Any such work performed as special counsel shall not be used in calculations
for raises, or pension purposes.

There is hereby established in the Borough of Lakehurst, the
position of Chief Financial Officer pursuant to N.J.S.A. 40A:9-140.10
to carry out the duties set forth under N.J.S.A. 40A:9-140.1.

Any person appointed to the position of Chief Financial Officer
shall meet the requirements of N.J.S.A. 40A:9-140.1, subject to the
statutory provisions for interim or temporary appointments and for
persons entitled to tenure in such position.

It shall be the duty of the Chief Financial Officer to perform
the duties of Municipal Treasurer, to attend to the proper fiscal
administration of the Borough and to keep all necessary and proper
accounts. The Chief Financial Officer shall carry out the responsibilities
set forth under N.J.S.A. 52:27-BB-26 et seq.; N.J.S.A. 40A:9-140.1
and any other duties required by law.

The Chief Financial Officer shall be appointed by the Governing
Body, and shall serve for a term of four (4) years which shall run
from January 1 in the year the Chief Financial Officer is appointed.
Pursuant to N.J.S.A. 40A:9-140.8, a Chief Financial Officer may be
granted tenure of office and, thereafter, shall not be removed therefrom
except for just cause and then only after a public hearing as required
by law.

The Governing Body shall determine the salary for the position
of Chief Financial Officer as set forth in the Salary Ordinance and
shall make necessary appropriations for payment of same.

The Governing Body shall appoint a Tax Assessor as required
by N.J.S.A. 40A:9-146.

The Tax Assessor shall hold the Tax Assessor's Certificate provided
for in N.J.S.A. 54:1-35.25 et seq. and shall have the duty of assessing
property for the purpose of general taxation. Nothing in this section
shall affect adversely the salary or tenure rights acquired pursuant
to N.J.S.A. 54:1-35.31 or any other law. In accordance with the provisions
of N.J.S.A. 54:3-16, the Assessor, when making assessments, shall
be governed by directions by the Ocean County Tax Administrator. These
directions shall be pursuant to rules adopted by the Ocean County
Tax Board.

The Governing Body shall determine the amount of compensation
for the Tax Assessor in the Salary Ordinance.

The Tax Assessor shall hold office for a term of four (4) years
from the first day of July next following his appointment. Vacancies
other than due to expiration of term shall be filled by appointment
for the unexpired term.

The Governing Body shall appoint a Tax Collector.

No person shall be appointed or reappointed as Tax Collector
unless he shall hold a Tax Collector's Certificate issued pursuant
to N.J.S.A. 40A:9-145.7. Any Tax Collector appointed pursuant to this
section may obtain tenure pursuant to the provisions of N.J.S.A. 40A:9-144
or 40A:9-145 et seq.

The Tax Collector shall hold his office for a term of four (4)
years from January 1 next following his appointment. Vacancies other
than due to the expiration of term shall be filled by appointment
for the unexpired term.

for the Tax Collector in the Salary Ordinance.

There is hereby created a position of Code Enforcement Officer.

In addition to the Code Enforcement Officer, the Lakehurst Police
Department is hereby authorized to perform the duties of the Code
Enforcement Officer.

Pursuant to N.J.S.A. App. A:9-40 et seq., there is hereby created
the Office of Emergency Management. The office shall be administered
by an Emergency Management Coordinator who shall be appointed by the
Mayor and subject to applicable Federal and State laws.

In addition to duties prescribed by Federal and State laws,
the Emergency Management Coordinator shall have the following duties
and responsibilities:
a. Be responsible
for the planning, organization, and direction of varied emergency
management operations within the Borough, coordinating the activities
of local municipal departments within the Borough and providing them
with necessary guidance and advice for the development of emergency
management programs.
b. Coordinate
the activities of the Borough emergency management staff and provide
definitive information concerning emergency management programs and
policies.
c. Prepare
budgets, statistical reports, evaluations and other reports as may
be required.
d. Conduct
studies and make changes in the existing organization and operation
to assure a continuity between all divisions of the Borough Emergency
Management Unit.
e. Establish
the Borough Emergency Operating Center.
f. Develop
and conduct drills and exercises for the Borough organization and
practice operations for the municipality in cooperation with the County
and State emergency organizations.
g. Confer
with municipal officials for the development of mutual aid programs,
for the planning and organization of emergency management programs
and the establishment of a municipal Emergency Management Unit, provide
advice and guidance on emergency management programs and policies,
and review plans for conformity with State and County programs.
h. Coordinate
and organize municipal emergency management plans for the Borough
as well as the utilization of municipal resources to assure their
most effective use.
i. Plan and
develop training programs for the Borough staff and assist in the
planning and review of the municipal training program for conformity
with County and State criteria.
j. In emergency
situations, coordinate the alerting and mobilization of the municipal
emergency management organizations and assist in the processing of
requests for emergency aid and the dispatching of aid to the points
of greatest need.
k. Attend
schools, seminars and meetings which enhance the overall emergency
management structure of the Borough.
l. Act as
Chief of Staff for the Mayor and Borough Council during emergency
situations and as may be provided in Statute.

There shall be created the position of Deputy Emergency Management
Coordinator, who shall act in the absence or disability of the coordinator.
Up to two (2) deputies may be appointed by the Coordinator. Deputy
Coordinators shall be appointed on an annual basis by the coordinator.

There is hereby created the position of Zoning Officer.

It is the duties of the Zoning Officer and the Lakehurst Police
Department to enforce the Land Development Ordinances of the Borough
of Lakehurst.

The Governing Body hereby finds and determines that it is necessary
and advisable for the efficient conduct of the affairs of the Borough
and more particularly, to facilitate the operation of the various
offices in the Borough by providing the assistance of deputies to
the existing office, that the offices of the deputies hereinafter
designated should be created.

There is hereby created the offices of Deputy Tax Assessor,
Deputy Treasurer, Deputy Tax Collector, Deputy Zoning Officer and
Deputy Code Enforcement Officer.

The Governing Body may appoint a Deputy Tax Assessor, Deputy
Treasurer, Deputy Tax Collector, Deputy Zoning Officer and Deputy
Code Enforcement Officer as in the sole discretion that they deem
it necessary. If a term has not been established by Statutes or ordinance,
the term of such officer shall be for one (1) year, commencing January
1 of each year and ending on December 31 or until his successor is
appointed. Should the office become vacant during any term, it shall
be filled by a similar appointment but for the unexpired term.

Qualification for deputy shall, whenever possible, be the same
qualifications as required for the positions and offices to which
they shall become deputies to the extent required by law and shall
be of legal age.

The duties of the Deputy Tax Assessor, Deputy Treasurer, Deputy
Tax Collector, Deputy Zoning Officer and Deputy Code Enforcement Officer
shall be to act as respective Tax Assessor, Treasurer, Tax Collector,
Zoning Officer and Code Enforcement Officer in the absence or disability
of the respective officer and shall have all the powers and shall
perform all the duties and functions of the office during the respective
absence or disability of the officer. At all other times the deputies
shall act as assistants to their respective officer and be under the
direction and control of the officer in charge of the office and to
perform such other duties and functions as required by the offices
or by the Governing Body.

The salary of the aforesaid deputies shall be as set forth in
the Salary Ordinance of the Borough. Notwithstanding that the deputy
may act in the capacity of the office to which he is deputy for any
extended period of time, he shall not by such reason be entitled to
an increase in salary other than set forth in the salary ordinance.
