Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the New Jersey Statutes shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use.

a. 
The Chief of Police is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days during specified hours on any day or days whenever he finds that such closing is necessary for the preservation of the public safety, health or welfare.
b. 
Any regulations promulgated by the Chief of Police and in accordance with paragraph a. above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c. 
Any violation of this regulation promulgated thereunder shall be punished by a fine not to exceed one hundred ($100.00) dollars.
d. 
Any regulation adopted that mandates the closing of any street for a period greater than forty-eight (48) consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.

Any vehicle parking in violation of this chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any peace officer may provide for the removal of such vehicle. The owner shall bear the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable for a penalty of not more than fifty ($50.00) dollars or imprisonment for a term not exceeding fifteen (15) days or both.

If any part or parts of this chapter are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.

When the Borough Council hereby finds and declares that problems of traffic control occur when traffic must be moved through or around street construction, maintenance operations, and utility work, above and below ground which requires blocking the roadway and obstructing the normal flow of traffic; and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safety and expeditious movement of traffic through construction and maintenance zones and to provide safety for the work force performing these operations.
The Borough of Lakehurst, in the County of Ocean, State of New Jersey does hereby adopt the current Manual on Uniform Traffic Control Devices hereafter known as M.U.T.C.D., except as hereby supplemented and amended, as it controls and regulates whenever construction, maintenance operations or utility work obstructs the normal flow of traffic. Any person, contractor, or utility, who fails to comply with the provisions of M.U.T.C.D. while performing such work is in violation of this section.

It shall be the responsibility of the person, contractor, or in the case of a public utility agreement the public utility wishing to conduct work on, under or above the roadway, to contact the Police Department in order to arrange a preconstruction meeting in order to submit plans for the safe movement of traffic during such period of construction work. Any person, contractor or utility who fails to comply with this section prior to the start of such work or whose plans are not approved by the Police Department is in violation of this section.

The person, contractor, or utility shall provide the Police Department with at least two (2) emergency contact phone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work. If for any reason emergency contact cannot be reached, or if the emergency contact person does not respond to the call from the Police Department to correct a hazardous condition, the Borough may respond to correct such hazardous condition. The reasonable fees for such emergency service by the Borough shall be charged to the person, contractor, or utility of such condition.

There shall be no construction, maintenance operations, or utility work on any roadway in the Borough before the hour of 9:00 a.m. or after 4:00 p.m. This time limit may be adjusted to permit work prior to 9:00 a.m. or after 4:00 p.m. by the officer in charge of the Police Department. If it is determined by the officer in charge that the construction or maintenance operations prior to 9:00 a.m. or after 4:00 p.m. would substantially delay traffic or cause a safety or health hazard, the work shall then be permitted only between 9:00 a.m. and 4:00 p.m.

Road closing and/or traffic detours shall not be permitted unless approved by the Police Department.

Traffic directors shall be posted at all construction or maintenance sites when determined by the Police Department that same is necessary to provide for the safety and expeditious movement of traffic.

The Police Department shall have the authority to stop work, including the removal of equipment and vehicles, stored material within the street right-of-way, back filling of open excavations and/or other related work, in order to abate any nuisance and/or safety hazard or for any violation of this section.

It is to be expressly understood that no materials, vehicle or equipment are to be placed in the roadway or sidewalk or until all construction, signs, lights devices and pavement markings are installed.

Any person, contractor or utility who commits a violation of this section shall, upon conviction thereof for a first offense pay a fine of not less than one hundred ($100.00) dollars nor more than five hundred ($500.00) dollars and/or be imprisoned in the County jail for a term not exceeding ninety (90) days. For a second offense, the person, contractor or utility shall, upon conviction thereof, pay a fine of not less than two hundred fifty ($250.00) dollars and/or be imprisoned in the County jail for a term not exceeding ninety (90) days.
A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.

All ordinances or parts of ordinances which are inconsistent with the provisions of this section are hereby repealed to the extent of any such inconsistency.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other, more restrictive provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S. 39:4-138, any other New Jersey Statute or as hereinafter provided.

a. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his absence, the ranking Police Officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b. 
The effectiveness of this section is contingent upon the signs being erected as required by law.

a. 
Whenever snow has fallen and the accumulation is such that it covers the surface of the streets or highways requiring the plowing of such roadways, an emergency shall exist and no vehicle shall be parked on any of the streets or highways or portions thereof within the Borough.
The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.
b. 
Any unoccupied vehicle parking or standing in violation shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.
c. 
For the period beginning twelve (12) hours before an expected snowfall and the initiation of removal operations from public streets and roadways within the Borough until twenty-four (24) hours after the end of such removal operations the provisions of Chapter 3 subsection 3-5.6, Storage of Vehicles and Parking on Residential Lawns Prohibited, shall be stayed. Vehicles may be stored on the front yard of properties in the Borough for a period not greater than twenty-four (24) hours after the end of snow removal operations.

Any single vehicle with a registered GVW (total weight of a single vehicle and its load) in excess of 26,000 lbs. upon any land, property or lot which is primarily used or zoned for residential purposes. The words and phrases stated and used in this section are intended to have the meanings set forth for such words and phrases respectively as set forth in Subtitle 1 of Title 39 of the New Jersey Statutes.
The provisions of this section shall not apply to the following:

2. 
Any vehicles used at or stored upon an active construction site.
b. 
No vehicle which contains, carries or transports hazardous materials and which is or should be placarded according to and complying with the Department of Transportation Hazardous Materials Regulations as published in Code of Federal Regulations, Title 49, shall be stored or parked in the Borough of Lakehurst unless such area or place for parking or storage has received approval for such use by the appropriate agencies or the Borough of Lakehurst.

No person shall move a vehicle not lawfully under his control into any such prohibited area or away from a curb such distance as is unlawful.
Pursuant to P.L. 1989, C 201, the penalties for violations must be two hundred fifty ($250.00) dollars for a first offense and for a subsequent offense must be a fine of at least two hundred fifty ($250.00) dollars and up to ninety (90) days community service on such terms and such form as the Court shall deem appropriate, or any combination thereof.
The owners of the premises referred to in subsections 7-37.3, 7-37.4 and 7-37.5 shall provide and install signs and pavement markings for each parking space reserved for the use of handicapped persons, which signs and markings shall be in accordance with the Manual on Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of the property. The owner shall, subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Borough of Lakehurst. The owner shall be responsible for the repair and restoration or replacement of same.
In accordance with the provisions of N.J.S.A. 39:4-197, the following Municipal and Board of Education property shall have the movement of traffic controlled by the type of regulation indicated. No person shall operate, or park a vehicle in violation of the regulations indicated.

In accordance with the provisions of N.J.S.A. 40:48-2.46, the following private property that is open to the public and to which the public is invited, the movement of traffic shall be controlled by the regulations listed herein. No person shall operate or park a vehicle in violation of the following regulations.
a. 
Use of Privately Owned Parking Lots Reserved for Patrons.

No person other than a patron of the business, shall park any vehicle in a privately owned lot marked at the entrance for use of patrons only. Further, an advisory sign shall indicate violators are subject to summons and removal at their expense.

The owner of the parking lot or his designee shall be the complainant in any action under this subsection.
2. 
The owner of the parking lot shall be responsible for the installation and maintenance of the appropriate signage for the lot.
3. 
Any vehicle parked in violation of this subsection shall be subject to removal. The owner of the vehicle shall bear the reasonable costs of removal and storage, which may result from such removal before gaining possession of the vehicle.
The owner of the premises referred to in this section shall provide and install signs and pavement markings as required, which signage and markings shall be in accordance with the current Manual On Uniform Traffic Control Devices (MUTCD). The cost of signs and installations shall be the responsibility of the owner of the property. The owner shall, subsequent to the initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Borough of Lakehurst.
The penalty for a violation and conviction of this section shall be not less than fifty ($50.00) dollars nor more than one thousand ($1,000.00) dollars and/or imprisonment in the County jail for a term not to exceed ninety (90) days, or by a period of community service not to exceed ninety (90) days.
In accordance with the provisions of N.J.S.A. 39:5A-1 the regulations of Subtitle 1 of the Title 39 of the New Jersey Statutes are hereby made applicable to the properties listed below.

The owners of the premises referred to in subsections 7-38.2 and 7-38.3 shall provide and install signs and pavement markings as required, which signage and markings shall be in accordance with the Manual of Uniform Traffic Control Devices. Consistent with N.J.S.A. 39:4-60 the Governing Body of the Borough of Lakehurst hereby authorizes the Lakehurst Volunteer Fire Co. Number 1 and the Lakehurst First Aid Squad to solicit contributions on roadways owned and maintained by the Borough of Lakehurst, provided:
a. 
Request to Police and Governing Body.

Written request to solicit contributions in or on a street or road within the Borough of Lakehurst will be provided to the Lakehurst Police Department and the Lakehurst Governing Body not later than two weeks prior to the event.
2. 
The request will provide the location, date and time (start and end) of the event and a contact name and number.
3. 
Attached to the request will be a sketch showing the details of the traffic plan; positions of advance warning signage, personnel and safety equipment.
b. 
Approvals from Other Jurisdictions.

Consistent with N. J. S. A. 39-4-60 approval from Ocean County or the New Jersey Department of Transportation must be acquired to solicit on roadways under those ownership.
c. 
Approval by the Lakehurst Police Department.
1. 
The Chief of Police, or his designee, shall timely approve, modify or deny any request to solicit contributions on any roadway or street within the Borough of Lakehurst based upon criteria established in N.J.S.A. 39:4-60, and the public safety.
2. 
The Lakehurst Police shall forward to the Municipal Administrator notice as to the disposition of any request to solicit contributions for distribution to the Governing Body.
3. 
At any time during the soliciting of contributions in or upon any roadway or street within the Borough, the Lakehurst Police Department may for reasons of public safety terminate the event or rescind the approval.

As used in this section:
LOW SPEED VEHICLE (LSV) shall mean a four-wheeled vehicle, as defined in 49 CFR s.571.3(b), whose attainable speed is more than twenty (20) miles per hour and no more than twenty-five (25) miles per hour on a paved level service. The LSV cannot be powered by gas or diesel fuel.

It shall hereafter be unlawful for any person to operate or park an LSV upon any roadways, streets, public or quasi-public properties within the Borough.

a. 
For a first offense the operator of an LSV shall be subject to a fine of not less than one hundred fifty ($150.00) dollars.
b. 
For a subsequent offense the operator of an LSV shall be subject to a fine of not less than five hundred ($500.00) dollars.
c. 
Any LSV found in violation of this section shall be subject to impound and towing at the owner's/operator's expense.
