No person shall place or maintain or cause to be placed or maintained any plant, tree, object, or vehicle having a height between three (3) feet above the grade of any street or less than eight (8) feet on any street or alley intersection which obstructs traffic. Such obstruction is deemed a public nuisance because it endangers the public safety. Any person refusing, failing, or neglecting to abate any such traffic obstruction after proper notice has been given shall be guilty of a misdemeanor. Utility poles, street name signs, traffic-control signs and other devices placed in such area under lawful authority of the city shall be exempt.

(a) 
Should any owner of any lot or lots within the city, who shall be in violation of section 12.06.001 hereof, fail, refuse, or neglect to cut down and/or remove any such traffic obstruction after proper notice, then the city shall have the authority to cut down or remove such obstruction as necessary. The notice and procedure for abating any traffic obstruction located on private property shall be as provided for in section 8.02.003 et seq. of this code.
(b) 
Should any plant, tree, object or vehicle encroach upon any public right-of-way, then the city shall have the authority to cut back or trim such plant or tree and to remove the object or vehicle, or portion thereof, from such public right-of-way.
