Charleston Township hereby elects to administer and enforce the provisions of the Pennsylvania Construction Code Act, Act 45 of 1999, 35 P.S. §§ 7210.101 through 7210.1103, as amended and supplemented from time to time, and its regulations.
The Uniform Construction Code, contained in 34 Pa. Code, Chapters 401 through 405, as amended and supplemented from time to time, is hereby adopted and incorporated herein by reference as the municipal building code of Charleston Township.
Administration and enforcement of the code within this Township shall be undertaken by entering into a contract with a code administrator, or other entity that is certified and qualified to act as such, for the administration and enforcement of this Act on behalf of the Township of Charleston. Charleston Township, by resolution, shall appoint the code administrator or administrators as the Township deems appropriate.
A Board of Appeals shall be established by resolution of the Township of Charleston, as is appropriate by law, in conformity with the requirements of the relevant provisions of the code, as amended from time to time, and for the purposes set forth therein. Charleston Township will appoint the appropriate members for the Board of Appeals as is necessary by law.
A. 
All building code ordinances or portions of ordinances, which were adopted by this municipality on or before the adoption of this chapter, including but not limited to Charleston Township Ordinance 137, are hereby rescinded.
B. 
All relevant ordinances, regulations and policies of this municipality not governed by the code shall remain in full force and effect.
C. 
All building code permits issued pursuant to Ordinance 137 prior to the effective date of this chapter shall remain valid and continue in full force and effect.
Fees assessable by the Code Administrator for the administration and enforcement undertaken pursuant to this chapter and the code shall be established by the Code Administrator, shall be consistent with law and shall be approved by the Township of Charleston.
