A code regulating open burning has been promulgated by the State Department of Environmental Protection after public hearing, pursuant to N.J.S.A. 26:2C-8, and has the full force and effect of law within the Township. A copy of the code shall be on file in the office of the Township Clerk. The code is commonly known and described as the "New Jersey Air Pollution Control Code, Chapter 2, Control and Prohibition of Open Burning," and all amendments and supplements thereto.[1]

No person shall burn or cause to be burned any leaves, grass, wastepaper, refuse, rubbish, garbage, trade waste, trees, brush, stumps or any other debris unless the same is burned in accordance with the provisions of Chapter 2 of the New Jersey Air Pollution Control Code.
All persons desiring removal by the Township of leaves, grass, wastepaper, refuse, rubbish, garbage, trade waste, trees, brush, stumps or any other debris shall deposit the same in suitable containers conveniently placed for removal by the refuse collectors of the Township; provided that, if the weight of any single item or container of such materials exceeds 40 pounds, such item or container shall not be so deposited, but shall be disposed of according to the instructions of the Public Works Superintendent.
Any person violating any of the provisions of this chapter shall be subject to the penalty set forth in Chapter 1, Article II, General Penalty, of the Code of the Township of Bordentown.
