[HISTORY: Adopted by the Township Committee of the Township of Bordentown as Ch. 2.52 of the 2003 Municipal Code. Amendments noted where applicable.]
A.
No Township Committee member or other Township employee shall accept from any person, whether directly or indirectly and whether by the person or through any partner or association, any gift, favor, service, employment or offer of employment or any other thing of value which the person knows or has reason to believe is offered to the person with intent to influence the person in the performance of the person's duties and responsibilities.
B.
No Township Committee member or other municipal employee shall represent, appear for, or negotiate on behalf of, or agree to represent, appear for, or negotiate on behalf of, whether by the person or by or through any partnership, firm or corporation in which the person owns, has an interest or controls, or by any partner, officer or employee of any such partnership, firm or corporation, any person or party, other than the Township, in any negotiations for the acquisition or sale by the Township of any interest in real or tangible or intangible personal property, provided that nothing contained in this subsection shall be deemed to prohibit any person from representing themselves in negotiations or proceedings concerning the person's interest in real property.
A Township Committee member who is a lawyer or other such professional shall be deemed to have an interest requiring open disclosure and will refrain from voting if the member or the member's partners or the member's firm represents any person or entity which deals with the Township even though neither the member nor the member's partners or the member's firm, in compliance with the preceding section, represent that client in its dealings with the Township.
No Township Committee member or other Township employee or any consultant of the Township may profit or seek to profit by the use of any information which the person acquires by reason of the person's connection with the Township which is not available to the general public. This requirement shall be attached to all contracts with consultants and delivered to all Township employees. An acceptance of employment, status as a consultant or a seat as a Township Committee member shall be deemed a waiver of any objection to the introduction of this provision in evidence in any civil suit by the Township to recover such profits.
No member of the Township Committee or other Township employee shall have or acquire any interest, direct or indirect, in any contract, subcontract or proposed contract or subcontract for construction, materials, or services or any lease, mortgage, agreement or sale or other contract of any nature relating thereto without forthwith making written disclosure to the Township, in form available to the public, of the nature and extent of the person's interest. Such disclosure shall be entered in writing in the minute book of the Township, provided that the word "interest" as used in this section shall not be deemed to include membership by a member of the Township Committee in any other public authority, nor shall it be deemed an interest to hold securities in companies listed on a major exchange or obligations of any public authority. Any Township official or employee having such an interest shall either immediately eliminate such interest or such conflict in a manner satisfactory to the Township or, in the discretion of the Township Committee deliberating in an open, recorded meeting, be removed as a Township official or employee of the Township subject to the provisions of civil service regulations, if applicable. Any Township official having such an interest shall in no event participate in any way in the negotiations of, consideration of, or voting upon any matter relating directly or indirectly thereto, nor communicate directly or indirectly in respect to the matter with any other person connected with the Township, and further, may, in the discretion of a majority of the Township Committee, other than Township Committee members having such interest, deliberating in open, recorded meeting, be required to immediately eliminate such interest or be recommended for removal from office by the process provided for removal or termination by the appropriate state statute, rule or regulation, or municipal ordinance.
