[Adopted as Ch. 2.84 of the 2003 Municipal Code]
Pursuant to the provisions of the New Jersey Laws of 1887, Chapter 68, as amended: N.J.S.A. 26:3-9, the Township Committee hereby adopts the provisions of Subdivision B of Article 1 of Chapter 3 of Title 26 of the New Jersey Revised Statutes, and the Township shall be subject to these provisions and shall not be subject to the provisions of Subdivision C thereof.
A. 
Pursuant to the provisions of the New Jersey Laws of 1887, Chapter 68, as amended: N.J.S.A. 26:3-3 et seq., there shall be a Local Board of Health which shall consist of the members of the Township Committee.
B. 
The terms of office of the members of the Local Board of Health shall coincide with those of the members of the Township Committee, and the termination of membership of any person serving on the Township Committee for any reason shall automatically terminate the individual's membership on the Local Board of Health. It is the intent and purpose of this subsection that, at any given time, the membership of the Township Committee and the Local Board of Health shall be identical.
C. 
The Local Board of Health shall meet as often as it deems necessary, but such meetings as are necessary shall be held at the same place and day as the Township Committee meets, immediately following adjournment of the Township Committee meeting. All meetings shall comply with the Open Public Meetings Act, N.J.S.A. 10:4-6 et seq.

The Local Board of Health shall have and exercise all the powers of a local board as provided by N.J.S.A. 26:3-31. It shall, in addition, have and exercise the power to adopt certain health codes and related documents by reference as provided in N.J.S.A. 26:3-69.1 et seq., and shall have and exercise the power to prescribe penalties for the violation of any provision of a health ordinance or code as provided in N.J.S.A. 26:3-70 et seq.

The Local Board of Health may appoint a Health Officer who shall hold a license as a health officer and who shall be the general agent of the Local Board of Health for the enforcement of its ordinances and the applicable laws and regulations of the state. The Local Board of Health may, in lieu of appointing said official, contract with the Burlington County Board of Commissioners to furnish all or any part of the services and perform all or any part of the duties of the official. The Health Officer shall enforce all laws, ordinances and regulations in the Township relating to the protection of public health, including all chapters of the New Jersey State Sanitary Code, the New Jersey Air Pollution Control Code, and all other codes having the force and effect of law within the Township, whether cited in this Code or not; all provisions regarding the treatment and prevention of communicable diseases, the existence of nuisances endangering public health, the care and handling of food, and all other matters pertaining to the public health. The Health Officer shall make or cause to be made all inspections required by law or ordinance and shall from time to time have the water furnished by the municipal water system analyzed and shall report the results of such analysis to the Local Board of Health.

The Township Clerk shall serve as Secretary to the Local Board of Health at no additional compensation.
The Township Physician shall serve as advisor to the Local Board of Health at no additional compensation.
