No insurance company authorized to issue fire insurance policies in this state shall pay any claims in excess of $2,500 on any real property located within the Township of Elsinboro unless or until the insured person claiming a loss has ordered an official certificate of search for municipal liens pursuant to N.J.S.A. 54:5-12 from the Collector of Taxes and submits to the fire insurance company said search certifying that all taxes, assessments and other municipal liens or charges, levied and assessed and due and payable against said property, have been paid, or the Township of Elsinboro has submitted a resolution to the said insurance company pursuant to § 74-2 of this chapter.
The Township Committee of Elsinboro may enter into an agreement, authorized by resolution, permitting payment of delinquent taxes, liens and other assessments in installments, or permitting redemption of a tax sale lien in installments, in those cases in which the Township Committee of Elsinboro Township is satisfied that the claim for fire damages is to be used to restore or improve the fire-damaged property. In the aforesaid circumstances, the fire insurance company shall be authorized to make full payment of the claim to the insured person after receiving a certified copy of a resolution authorizing said installment payments.
This chapter shall take effect according to law, and a certified copy thereof filed with the New Jersey Commissioner of Insurance.
