(a)
Continued maintenance and observance of the standards contained in this division are conditions that must be complied with in order to obtain a license and to obtain a license renewal.
(b)
It is unlawful for any person to permit or allow more than one family to reside in any apartment complex dwelling unit.
(c)
All city building, electrical, plumbing, health, zoning and other applicable ordinances or codes must be complied with at all times.
(d)
The maximum number of persons per dwelling unit density in an apartment complex is as follows:
(1)
The maximum number of adults that a landlord may allow to occupy a dwelling is three times the number of bedrooms in the dwelling. Adult shall mean an individual 18 years of age or older;
(2)
The landlord may only allow a higher maximum occupancy if required by applicable state or federal housing laws that preempt this section;
(3)
The licensee shall keep records identifying all tenants in each unit and head of household. Records shall be available for review by the building official during regular working hours upon receipt of reasonable notice; and
(4)
An owner is not prohibited from establishing a more restrictive maximum occupancy for each dwelling unit within an apartment complex.
