(a) 
Continued maintenance and observance of the standards contained in this division are conditions that must be complied with in order to obtain a license and to obtain a license renewal.
(b) 
It is unlawful for any person to permit or allow more than one family to reside in any apartment complex dwelling unit.
(c) 
All city building, electrical, plumbing, health, zoning and other applicable ordinances or codes must be complied with at all times.
(d) 
The maximum number of persons per dwelling unit density in an apartment complex is as follows:
(1) 
The maximum number of adults that a landlord may allow to occupy a dwelling is three times the number of bedrooms in the dwelling. Adult shall mean an individual 18 years of age or older;
(2) 
The landlord may only allow a higher maximum occupancy if required by applicable state or federal housing laws that preempt this section;
(3) 
The licensee shall keep records identifying all tenants in each unit and head of household. Records shall be available for review by the building official during regular working hours upon receipt of reasonable notice; and
(4) 
An owner is not prohibited from establishing a more restrictive maximum occupancy for each dwelling unit within an apartment complex.

As a condition for issuance of a license or license renewal, an apartment complex and the premises on which it is situated must first be in full compliance with the following requirements:
(1) 
Eliminating any hole, excavation, sharp protrusion, and any other object or condition that exists on the premises and that is reasonably capable of causing injury to a person;
(2) 
Securely covering or closing a well, cesspool or cistern;
(3) 
Providing an adequate number of solid waste receptacles or containers on the premises and arranging for frequent removal of such waste materials;
(4) 
Providing drainage to prevent standing and stagnant water on the premises (no filling, excavation or other improvement may be performed or constructed on any property which will have an adverse effect on existing drainage patterns on an adjacent property);
(5) 
Removing trees and tree limbs that are reasonably capable of causing injury to a person;
(6) 
Maintaining all retaining walls in a good and safe condition;
(7) 
Maintaining all unpaved areas with grass, ground cover, or other type of landscaping to such an extent that the soil, when wet, will not be picked up and spread to sidewalks or adjacent private or public property and is not subject to erosion during rains;
(8) 
Keeping doors and windows of all vacant or unoccupied dwelling units securely closed and locked to prevent unauthorized entry;
(9) 
Keeping sidewalks and public walks free of mud, debris, frozen precipitation or other obstruction that would impair or prevent their use or would be reasonably capable of causing injury to a person;
(10) 
Eliminating rodents and vermin in or on any part of the premises;
(11) 
Maintaining the interior of a vacant structure or vacant portion of a structure free from rubbish and garbage;
(12) 
Keeping the interior of a vacant structure or vacant portion of a structure free from insects, rodents, and vermin;
(13) 
Removing a building or other structure that is in such a dilapidated or damaged condition that it is unfit for human habitation, does not serve its original intended function, or is kept in such an unsanitary condition that it is a menace to the health of people residing in the vicinity thereof, or presents a dangerous fire hazard in the vicinity where it is located; and
(14) 
Keeping all areas of the buildings, grounds, facilities and appurtenances in a clean and sanitary condition.

As a condition for issuance of a license or license renewal, an apartment complex and the premises on which it is situated must first be in full compliance with the following requirements:
(1) 
Window panes and screens must be constructed and maintained in such relation to the adjacent wall construction so as to exclude rain, moisture, and insects as completely as possible from entering the dwelling or structure;
(2) 
Railings for stairs, steps, balconies, porches, and elsewhere must be maintained as specified in the city’s ordinances, regulations or codes that were in effect at time of construction of the structure. They must be kept in sound repair, and their exterior surface materials must be maintained weatherproof and must be surface coated or protected as required to prevent deterioration;
(3) 
The exterior doors, door hinges, and door latches of every habitable structure must be maintained in good condition. Door locks in exterior doors of dwelling units shall be maintained in good repair and capable of tightly securing the door;
(4) 
Parking lots, fire lanes, and required paved areas must be marked with legible parking and fire lane markings in accordance with city ordinances;
(5) 
Decorative features, such as cornices, entablatures, belt courses, corbels, terra-cotta trim, and wall facings, of every structure must be maintained in good repair with proper anchorage and in a safe condition;
(6) 
All exterior attachments, such as canopies, marquees, signs, awnings, stairways, fire escapes, standpipes, rain gutters, exhaust ducts and similar overhang extensions, attached to a structure must be maintained in good repair and be properly anchored so as to be kept in a safe and sound condition, and their exterior surface materials shall be maintained weatherproof and must be surface coated or protected as required to prevent deterioration;
(7) 
Burglar bars shall comply with requirements of the building code and other codes or ordinances of the city. Burglar bars on windows of bedrooms of residential structures shall be constructed and maintained in such a way so as to be operable and able to open from the interior of the residence without use of a key or special knowledge or effort;
(8) 
Garage doors must be capable of being fully closed and secure, and must be kept in sound condition and good repair;
(9) 
Any building or structure must be painted, waterproofed, and repaired to prevent deterioration due to the elements. Conditions requiring repair include but are not limited to loose siding with holes, excessive cracks, or rotted boards which may permit air or water to penetrate rooms; loose roof covering; holes or leaks in the roof which may cause damage to the structure or rooms; and rotting, sagging, or deteriorating supports for steps, stairs, or porches. The exterior of all buildings, including roofs, shall be maintained to such an extent as to be free of rot, decay or deformity; and
(10) 
All fences must be maintained reasonably closed and structurally sound. Each structural and decorative member of a fence shall be free of deterioration and be compatible in size, material, and appearance with the remainder of the fence.

As a condition for issuance of a license or license renewal, all installed systems utilized by an apartment complex, including but not limited to plumbing, electrical, heating, or air conditioning systems, must be maintained in a structurally sound and operative condition, and must:
(1) 
Provide and maintain in working order connections to discharge sewage from a structure or premises into a public sewer system;
(2) 
Provide and maintain in working order a toilet connected to a water source and to a public sewer in each dwelling unit;
(3) 
Provide and maintain in working order connections and pipes to supply potable water at adequate pressure to a dwelling unit;
(4) 
Provide and maintain a device to supply hot water of a constant minimum temperature of 120° Fahrenheit within each dwelling unit;
(5) 
Provide, connect and maintain in working order a kitchen sink, bathtub or shower and lavatory to a cold and hot water source in a dwelling unit;
(6) 
Connect plumbing fixtures and heating equipment that the owner supplies in accordance with the city plumbing code and the city mechanical code;
(7) 
Provide heating equipment capable of maintaining an inside temperature equal to or greater than 68° Fahrenheit in each room of a dwelling unit;
(8) 
Provide and maintain air conditioning equipment capable of maintaining an inside temperature equal to or less than 78° Fahrenheit when the outside temperature is 98° Fahrenheit;
(9) 
Provide and maintain supply lines for electrical service to each dwelling unit;
(10) 
Connect each heating device that burns solid fuel to chimney or flue;
(11) 
Provide and maintain electrical circuits and outlets sufficient to safely carry a load imposed by reasonable use of appliances and fixtures; and
(12) 
Pay all utility bills in a timely manner to prevent all cut-off of utilities by utility companies.
