(a)
The driver of any vehicle, motor vehicle or animal shall obey
the instructions of any official traffic-control device, sign, signal
or marking applicable thereto placed in accordance with this article,
unless otherwise directed by a law enforcement officer, subject to
the exceptions granted the driver of an authorized emergency vehicle
as provided for in the state motor vehicle laws.

Any person violating any of the provisions of this article shall,
upon conviction, be fined the maximum amount allowed by law.

(a)
All future traffic-control signs, signals, devices, or markings
erected or installed upon, over, along or beside any highway, street
or alley as necessary to enforce traffic laws and ordinances shall
be erected, installed, or placed in accordance with this article and
consistent with the Manual on Uniform Traffic-Control Devices and
the standards and basic principles that govern the design and usage
of traffic-control devices as set forth by the state.
(b)
Subject to the approval or ratification of the city council,
the city administrator or her designee is authorized and directed
to adopt traffic-control signs, signals, devices, and markings to
regulate, warn, and guide traffic in accordance with this article
and consistent with the Manual on Uniform Traffic-Control Devices
and the standards and basic principles that govern the design and
usage of traffic-control devices as set forth by the state.
(c)
The existence of a traffic-control device, signal, or sign shall
constitute prima facie evidence that such device, signal, or sign
is an official traffic-control device, signal, or sign lawfully erected
and placed.
(d)
The city secretary shall maintain a list of the authorized traffic-control
devices erected or installed within the city.

All traffic-control signs, signals, devices and markings placed
or erected prior to the adoption of this section and in use for the
purpose of regulating, warning or guiding vehicles or pedestrian traffic
are hereby affirmed, ratified and declared to be official traffic-control
devices, provided such traffic-control devices are not inconsistent
with the provisions of this chapter or state law.

It shall be the duty of the superintendent of streets, or other
employee of the city, to erect and maintain stop and yield signs as
designated by the ordinances of the city. It shall also be such person’s
responsibility to assure that signs are not obstructed by trees, bushes
or any other object.

The city shall have the authority to order any property owner
or person in control of a property to remove any such obstruction.
Should a property owner fail to comply with such order, the city shall
remove the obstruction, with all costs of such removal to be paid
by the property owner or person in control thereof.

It shall be unlawful for the operator of any motor vehicle to
fail to stop such vehicle at any lawfully erected stop sign, or to
fail to yield the right-of-way to another vehicle at any lawfully
erected yield sign, and [such person] may be fined in accordance with
the provisions of the state motor vehicle laws for such violation.

It shall be unlawful for any person to tamper with, move, alter,
deface, damage or willfully obstruct any stop or yield sign.

(a)
All stop and yield signs erected within the city shall be in compliance
with the provisions of the Federal Highway Safety Act and the state
department of transportation regulations on uniform traffic-control
devices.
(b)
Any stop or yield signs which are presently existing, and not in
compliance with the provisions of this division, shall be brought
within compliance, or shall be forthwith removed.

Traffic on any street within the city which terminates at the
intersection of another street or highway, and which has not been
designated as a stop or yield intersection, shall stop and yield to
traffic on such street or highway before entering same.

Any person who fails to comply with the provisions of this division shall be guilty of a misdemeanor. For violating the provisions of section 12.02.033 or 12.02.036 the fine shall be not less than $25.00 nor more than $200.00. For violating section 12.02.034 the fine shall be not less than $100.00 nor more than $200.00.
