(a)
Prohibition.
Smoking and/or the use of any tobacco products
in any and all city-owned or operated facilities and all city-owned
vehicles and all city-owned machinery is prohibited, including but
not limited to the following:
(1)
City hall.
(2)
City council chambers.
(3)
EMS and police departments and the municipal court.
(4)
Fire department and other offices located in the same building.
(5)
City service center, city shop, and city service center offices.
(6)
Municipal airport, including the lounge area, airport offices, and
other city-owned enclosures located at the municipal airport.
(7)
Senior citizens center.
(8)
Golf pro shop.
(9)
Housing authority.
(10)
Wastewater treatment plant.
(11)
Water treatment plant.
(12)
Boy Scout Lodge.
(13)
Girl Scout Lodge.
(14)
Landfill office.
(15)
Offices, buildings and other enclosures located at the G. Rollie
White Complex.
(16)
Ed Davenport Civic Center.
(17)
Brady Lake store.
(18)
Brady Lake marina.
(19)
Any and all enclosed buildings owned and operated by the city at
the present time and any additional buildings that may be purchased
or constructed in the future.
(b)
Designated smoking areas.
Designated smoking areas may
be created.
(c)
Smoking near entrance.
No smoking will be allowed nearer
than 50 (fifty) feet from any entrance of any city building or facility.
(d)
Posting of signs.
It shall be posted in all city-owned
facilities that such a facility is a tobacco/smoke free environment.
(e)
Penalty.
If any person shall violate the provisions of this section, they shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine in an amount in accordance with the general penalty provided in section 1.01.009 for each offense.
(f)
Applicability of other laws.
This section shall not
be interpreted or construed to permit smoking where it is otherwise
restricted by other applicable laws.
