(a) All
activities in the city park shall be subject to the following rules
and regulations:
(1) The park will close at 12:00 midnight and daily during the summer
months when the Coleman Independent School District is not in session.
When school is in session, the park will close at 10:00 p.m. daily.
(2) No overnight camping shall be permitted in the confines of the park
area.
(3) Any electrical outlets in the park shall be used only for small appliances
and shall not be used by motor homes, camper trailers, mobile homes
or other large volume users.
(4) Dumping or discharge of sewage or wastewater from any recreational
vehicle is strictly prohibited.
(5) All trash containers located in park are to be used only for disposal
of trash and garbage generated by activities within the park. Absolutely
no trash or garbage from outside sources shall be brought into the
park and placed in containers.
(6) Possession or consumption of alcoholic beverages within the confines
of the park shall be prohibited.
(7) No person shall thrash pecan trees on park property or on any other
property belonging to the city.
(8) Persons or organizations shall not be allowed to charge admission
to any concert, exhibition, meeting, or other event on park property.
(9) No organized event by any club, civic group, or other organization
shall be scheduled on park property without the prior consent of the
city. In the event of the scheduling of any such activity, a deposit
fee as maintained on file in the office of the city secretary shall
be paid to the city, in advance, which shall be a security for cleanup
and damage repair of the park area after such event or activity. Said
deposit shall be refunded within ten (10) days after the activity,
if the park area is properly cleaned and there is no damage to the
area. Otherwise, said deposit fee shall be applied to the actual cost
of cleanup or damage repair, and any balance remaining will then be
refunded to the sponsor of the activity. Such deposit fee shall not
be a limit on the liability of any sponsoring group or person, and
if damage or cleanup exceeds the deposit amount, such group or sponsor
shall be responsible for any excess costs.
(b) The
city council shall have the authority to grant a variance of subsections
(a)(1)–(3), (8) and (9) of the above rules, upon application
and showing of good cause, with respect to an individual event or
activity.
(c) Any person or persons, firm, organization or corporation violating the provisions of this section, upon conviction of such violation, shall be deemed guilty of a misdemeanor and shall be fined in accordance with the general penalty provision set forth in section
1.01.009 of this code for each offense, and where applicable, each day such violation continues shall constitute a separate offense.

Variances to section
1.04.026 shall be granted as follows:
(1) The
Coleman County Chamber of Commerce, Agriculture and Tourist Bureau
(“chamber”) is hereby granted exclusive use of the city
park premises for the annual Fiesta de la Paloma (“fiesta”)
for every year unless terminated or modified by the city.
(2) The
exclusive control of the premises shall begin at 8:00 a.m. on Friday
and end at 10:00 p.m. on Saturday of the weekend of the fiesta.
(3) The
chamber shall be permitted to charge a reasonable admission fee on
the day of the fiesta and may charge a fee to vendors or exhibitors
in its discretion.
(4) The
chamber may use existing restroom facilities but shall provide a sufficient
number of portable toilets.
(5) There
shall be no use of the tennis courts for nontennis activities without
the prior consent of city management.
(6) The
replica building may be used during the week prior to the fiesta if
the museum collection has been removed from said building.
(7) The
grass area west of the replica may be used during the fiesta for a
car show or similar exhibition, but only in the event that the soil
condition is sufficiently dry and firm so that no significant damage
shall occur. In the event of questionable conditions, the decision
of the city shall be final.
(8) The
chamber shall furnish a certificate of public liability insurance,
and shall assume sole responsibility for damage or injury to persons
or properties which occurs during the fiesta and on the premises.
(9) At
least ten (10) days prior to the fiesta, the chamber shall file with
the city a report showing the proposed activities and schedule for
the fiesta, together with a traffic and parking plan. Such traffic
and parking plan shall insure adequate access for police and emergency
vehicles to all parts of the park area, and police, emergency and
city personnel shall be exempt from any admission fees and shall have
access at all times.
