(a)

It shall be unlawful for any person to allow horses or any other livestock within fifty (50) feet of any person’s dwelling other than the owner’s dwelling.

(b)

Manure and droppings shall be removed from pens, stables, yards, etc., on a regular basis and disposed of in such a manner to keep the premises free of any nuisance.

(c)

Watering troughs and tanks shall be maintained and cleaned regularly in such a way to prevent the breeding of flies, mosquitoes or other insects.

(d)

Provided that the owner of livestock complies with the foregoing requirements, this section does not prohibit livestock from being kept in the corporate limits of the city by a youth participant in an FFA and/or 4-H program for an FFA and/or 4-H project under the supervision of a vocational agricultural teacher or county agent, including keeping the animals at the new high school agricultural facility.

(a)

A hog or hogs may be kept in the corporate limits of the city under the following conditions:

(1)

The hog or hogs must be an FFA or 4-H show project under the supervision of a vocational agriculture teacher or county agent.

(2)

Each hog must be owned by a youth participant in an FFA or 4-H program.

(3)

Each hog must be identified and registered with the city inspector or designated agent of the city. Such registration must specify the location where the hog will be kept.

(4)

Any person wishing to keep qualifying hog(s) at a location within the city limits shall obtain a permit from the city at a fee to be determined by the city council on an annual basis. The initial fee shall be as set from time to time by the city council and shall be maintained on file in the office of the city secretary. The permit shall specify the exact location and the maximum number of hogs at such location. In no event shall the number of hogs at a location exceed six (6).

The hogs shall be confined in pens and shall not be allowed to roam on the property. The pens shall be at least 100 feet from the nearest neighboring dwelling. Compliance with this distance requirement will be reviewed annually each time a permit application is filed. Rights of neighboring property owners will prevail over permit rights at all times.

Hog pens shall be kept clean at all times with no standing water or wallow holes.

(7)

No more than one permitted site shall be allowed on any property. Use of permitted site(s) shall be limited to the purposes set out herein. No breeding, slaughtering or other activity will be permitted on any site.

(8)

Notwithstanding any other provision of this section, the sites permitted hereunder shall be subject in all respects to existing or future health and nuisance ordinances, and violation of same will result in revocation of the permit and immediate removal of the hogs.

(b)

The registration and permits granted under this section will specify the time frame in which each hog shall be at such site.

(c)

The granting of any permit under this section shall constitute consent by both the hog owner and site owner for inspection by the city inspector or his designated agent at all reasonable times to insure compliance with permits and in all other respects.

(d)

Any person found not in compliance with any permit or provision of this section, upon conviction of same, shall be deemed guilty of a misdemeanor and shall be subject to a fine in accordance with the general penalty provision set forth in section 1.01.009 of this code. Each such conviction shall be deemed as an automatic revocation of any permit granted hereunto, and each day such violation continues shall constitute a separate offense.
