It shall unlawful for any person, firm or other entity to conduct any mining, drilling, or excavation activities for the exploration, development or production of minerals on any land located within the city limits, without first obtaining prior consent to conduct such activity or activities from the city council. Such consent, if given, shall be by way of a resolution passed by the city council authorizing such activity or activities and under the terms and restrictions, if any, as set out in said resolution.

Any person, firm, or other entity who shall, without first obtaining prior consent from the city council, conduct any mining, drilling or excavation activities for the exploration, development, or production of minerals on any land located within the city limits shall be guilty of a misdemeanor and shall be punished by fine in accordance with the general penalty provision set forth in section 1.01.009 of this code, and each day that such activity is conducted by such person, firm or other entity without such consent shall constitute a separate offense.
