A certain document, one (1) copy of which is on file in the office of the city secretary, being marked and designated as the International Building Code, 2018 edition, as published by the International Code Council, be and is hereby adopted as the building code of the city for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use and the demolition of such structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said building code on file in the office of the city secretary are hereby referred to, adopted, and made a part hereof, as if fully set out in this division, with the additions, insertions, deletions and changes, if any, prescribed in section 4.02.027 of this division.

(a) 
The following sections are hereby revised:

Section 3410.2. Insert: Date to coincide with effective date of building code adoption.
(b) 
Each reference to “board of appeals” is hereby amended to provide that the composition of the board of adjustments and appeals of the city shall be the city council.
(c) 
Each reference to the qualification requirements for members of the “board of appeals” is hereby repealed.
(d) 
Any reference or requirement that requires a written application for appeal to be filed within timelines contrary to this section is deleted.

Nothing in this division or in the building code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance repealed as provided in the ordinance from which this section derives; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this division.

Any person who violates a provision of this code, or fails to comply therewith, or with any of the requirements thereof, shall be guilty of a misdemeanor, and subject to a fine of between $1.00 and $2,000.00. Each day a violation occurs constitutes a separate offense.
