All requests for use of streets, alleys, and thoroughfares to support a private or commercial activity, which will require the roadway to be changed, cut, or damaged in any way, or to bore under the roadway, must be approved by the city council before any action may be started.

Bore.
A technique to drill a passageway below the surface of a roadway so the surface is undisturbed and its functional support is not affected.
Change.
To construct, extend and maintain in, along, under and across the present and future streets, alleys, highways and public grounds and ways.
Cut.
To cut the roadway in such a fashion that the original material is separated and is open to weather factors, and vehicle travel wear-and-tear that will destroy the road surface quicker than the original surface condition would allow.
Damage.
To change the surface of the original road material in such a fashion that its support of vehicle traffic is impaired or degraded and the roadway will degrade quicker than the original surface condition would allow.
Public roadway.
Any present or future street, alley, highway, public grounds and ways, and thoroughfares.

(a) 
Application.
(1) 
Approval to do any work that will affect (change, cut, damage, or bore under) a public roadway will require an application for a permit from the city.
(2) 
The mayor will sign all approved permits.
(b) 
Consideration.
(1) 
All permit requests to be considered at the next regular city council meeting must be received by the first Tuesday of a month.
(2) 
Permit requests that require consideration before the next regular meeting must be submitted with a full explanation to the urgency of the work, and how delay will damage the project. The mayor will make the final decision for when the request will be considered.

(a) 
Repair.
All roadways cut or damaged will be repaired with similar materials and workmanship to the original surface.
(b) 
Return.
All repair of roadways will return the surface to a condition that is the same as or better than the original surface state.

(a) 
City responsibility.
The city council will be responsible for approving all work that will change, damage, or bore under, any public roadway. The city will maintain records of all work performed under public roadways and will provide appropriate information, upon request, when any work is being considered and a permit applied for to gain approval to do the work.
(b) 
Liability.
Although the city may approve private or commercial work to be performed under a public roadway, the city accepts no liability for future work that may rupture this private or commercial service. Contractor accepts all liability to repair, alt-route, or replace any damaged material due to future work. Any public work, or work performed on behalf of the public, will be accomplished with normal care, caution, and diligence. Every normal attempt will be made to avoid damage to a private or commercial pipe or line, but the contractor/owner retains responsibility for repair of damage.

A new permit is required under the following conditions:
(1) 
Change of action;
(2) 
Adding to action first approved;
(3) 
Converting from one method to another; or
(4) 
Increasing the area to be affected.

(a) 
Fee.
(1) 
A road-cut request fee is $100.00.
(2) 
A road-bore request fee is $50.00.
(b) 
Payment.
All fees shall accompany a request for permit at the time of application.
(c) 
Refund.
(1) 
A full refund shall be issued within five (5) days if a request is denied.
(2) 
A full refund shall be issued when a request is to be held pending action for more than forty-five days (45).
