(a) 
The purpose of this article is to assist in the management and orderly maintenance of streets, rights-of-way and drainage culverts, to minimize the location of debris, loose material or refuse or any other disruption to the thoroughfares of the town and to otherwise protect the safety, security, appearance and condition of the streets, rights-of-way and drainage culverts from congestion, inconvenience, deterioration, visual impact and other adverse affects and costs to the citizens.
(b) 
Hereinafter, it shall be unlawful for any person to knowingly, willfully, negligently or carelessly throw, deposit, place, cast, scatter, dump, pile, leave or lay any debris, loose materials or refuse upon any public street, right-of-way or drainage culvert.

This article applies to all persons, who work in, adjacent to or near the streets, rights-of-way or drainage culverts to perform public services for the town or private services to any resident(s). All such operations are responsible for ensuring that the general condition of the street, rights-of-way or drainage culverts are free from any debris, loose material or refuse.

Building official.
The individual authorized to issue any and all building or construction permits and to perform inspections of same for the town.
Contractor.
Any licensed persons performing building, electrical, plumbing, heat/air and extermination services; those persons performing general construction activities such as painting, roofing, masonry and gate or fence work.
Debris.
Any construction materials such as aluminum, metal or wood, building products, fencing, galvanized posts, wrought iron, nails, screws, roofing nails, tacks or brads.
Director of public works.
The individual authorized to oversee the provision of water and wastewater services and monitor and oversee utility operations in the town.
Drainage culvert.
The inlet adjacent to the street which serves as the collector for runoff.
Landscape professionals.
Those persons engaged in the mowing, trimming or planting of various vegetation such as trees, bushes, lawns, shrubs, flowers and plants or any other material used in landscaping or installation of irrigation systems.
Load.
A load of loose material.
Loose material.
Material that can be blown or spilled from a vehicle because of movement or exposure to air, wind currents or other weather. The term includes dirt, gravel, sand, refuse or wood chips; landscaping materials such as fertilizer, grass, mulch, soil, trees, bushes or shrubs, limbs or brush; liquid in any form especially those that seep, leak or drop from commercial vehicles including wet cement, asphalt, tar, fuel, oil, solvent or hydraulic fluid; or any other material that could impair the streets, rights-of-way or drainage culverts.
Person.
A natural person (an individual), corporation, company, association, partnership, firm, limited liability company, joint venture, joint stock company or association and other such legal entity.
Public rights-of-way.
The area on, below or above a public roadway, street, public sidewalk, alley, waterway or utility easement in the town. The term does not include town property.
Refuse.
Trash, rubbish, garbage, litter such as newspaper, magazines, paper, circulars, flyers, advertisements or any other discarded material.
Town.
The territorial, corporate and geographic limits of the Town of Westover Hills, Texas.

All persons performing work in the town shall adhere to the following rules regarding general maintenance of the streets, rights-of-way and/or drainage culverts.
(1) 
Subsequent to a permit issued by the building official or their designee, and at a time prior to final inspection, any contractors performing building, electrical, plumbing, roofing or other general construction shall thoroughly clean the site to ensure it is free of debris, loose material, refuse or any other construction product. The building official shall provide a checklist to contractors with each permit issued and shall seek compliance prior to final approval for construction services.
(2) 
Landscape professionals shall remove any landscape remnants or loose material following completion of their work especially leaves, limbs, brush and grass clippings. All job specific loads shall be secured to prevent loose material from blowing into the street, rights-of-way or drainage culverts. The chief of police is authorized to seek voluntary compliance of the street maintenance standards associated with this article especially through patrol activity.
(3) 
Contractors are not permitted to clean job sites by washing residual debris, loose material or refuse into any drainage culvert for any reason. The director of public works will perform routine inspections of the streets, rights-of-way and drainage culverts to address compliance.
(4) 
The transport of any liquid material shall be secured so as to not be discharged onto the street, right-of-way or washed into a drainage culvert.
(5) 
The removal of any litter or refuse shall be properly tarped to avert discharge onto the public right-of-way or to an adjacent property.
(6) 
Under no circumstances are contractors or landscape professionals allowed to place any debris, loose material or refuse or other material on the streets for any purpose, including, yet not limited to dirt, mulch, cement, rock, stone, piping, steel, iron, fencing, roofing material or any other construction product.
(7) 
Immediately upon completion of work authorized by permit issued by the building official or director of public works, or other official of the town, the contractor shall remove from the area all unused material, dirt, debris, loose concrete or any other construction product. The contractor shall see that the entire area is broom clean and usable.

Any person or entity violating any of the provisions of this article shall be guilty of a misdemeanor, and upon conviction thereof shall be fined pursuant to section 1.01.009 of this code.
