The term "landlord" as used in this article shall mean the person
or persons who own, or purport to own, or exercise control of any
building or project having one or two units in which there is rented
or offered for rent housing space for living or dwelling purposes
under either a written or oral lease, provided that this definition
shall not include owner-occupied two unit premises. As used in this
article, this definition does not include any multiple dwelling subject
to the "Hotel and Multiple Dwelling Law," P.L. 1967, c. 76 (N.J.S.A.
55:13A-1 et seq.).
Every landlord shall, when obtaining a certificate of inspection for new occupancy of a unit of dwelling space pursuant to Chapter
64, Article
II, complete and file with the Mannington Township Clerk (or with the Mannington Township Housing Officer, if so designated by the Clerk) a certificate of registration form as prescribed by the New Jersey Department of Community Affairs pursuant to N.J.A.C. 5:29-1.1 et seq., which shall contain the following information:
A. The name and address of the record owner or owners of the premises
and the record owner or owners of the rental business if not the same
persons. In the case of a partnership the names of all general partners
shall be provided;
B. If the record owner is a corporation, the name and address of the
registered agent and corporate officers of said corporation;
C. If the address of any record owner is not located in the county in
which the premises are located, the name and address of a person who
resides in the county in which the premises are located and is authorized
to accept notices from a tenant and to issue receipts therefor and
to accept service of process on behalf of the record owner;
D. The name and address of the managing agent of the premises, if any;
E. The name and address, including the dwelling unit, apartment or room
number of the superintendent, janitor, custodian or other individual
employed by the record owner or managing agent to provide regular
maintenance service, if any;
F. The name, address and telephone number of an individual representative
of the record owner or managing agent who may be reached or contacted
at any time in the event of an emergency affecting the premises or
any unit of dwelling space therein, including such emergencies as
the failure of any essential service or system, and who has the authority
to make emergency decisions concerning the building and any repair
thereto or expenditure in connection therewith and shall, at all times,
have access to a current list of building tenants that shall be made
available to emergency personnel as required in the event of an emergency;
G. The name and address of every holder of a recorded mortgage on the
premises;
H. If fuel oil is used to heat the building and the landlord furnishes
the heat in the building, the name and address of the fuel oil dealer
servicing the building and the grade of fuel oil used.
The Mannington Township Clerk (or the Mannington Township Housing
Officer, if so designated by the Clerk) shall index and file the completed
certificate of registration forms and make them reasonably available
for public inspection. The Mannington Township Clerk (or the Mannington
Township Housing Officer, if so designated by the Clerk) shall also
index and file any validated certificates that are sent to the Mannington
Township Clerk by the New Jersey Bureau of Housing Inspection for
multiple dwellings that are subject to the "Hotel and Multiple Dwelling
Law," P.L. 1967, c. 76 (N.J.S.A. 55:13A-1 et seq.) and shall make
such validated multiple dwelling certificates reasonably available
for public inspection in the same manner as the certificates that
are required herein for one- and two-dwelling non-owner-occupied units.
Every landlord shall file an amended certificate of registration
form within 20 days after any change in the information required to
be included thereon.
At the time of the creation of a new tenancy, every landlord
must provide each occupant or tenant a copy of the completed certificate
of registration form. If an amended certificate of registration form
is filed with the Mannington Township Clerk (or the Mannington Township
Housing Officer, if so designated by the Clerk) the landlord must
furnish each occupant or tenant with a copy of the amended certificate
within seven days after such filing.
Within 30 days following notification by the Mannington Township
Clerk pursuant to section 1 of P.L. 2017, c. 266 (N.J.S.A. 40:48-2.67),
and thereafter, at the time of creation of a tenancy, each landlord
shall advise each tenant that the Mannington Township Clerk maintains
a list containing the names and addresses of Township residents who
identify themselves as being in need of special assistance in the
event of an emergency, and who request that this information be maintained
on their behalf, for public safety purposes. The landlord shall provide
each tenant with a copy of the notice, including information as to
how a tenant may be added to the list.
Any landlord who shall violate any provision of this article
shall be liable to a penalty of not more than $500 for each offense,
recoverable by a summary proceeding under "the penalty enforcement
law" (N.J.S.A. 2A:58-1 et seq.). The Superior Court, Law Division,
Special Civil Part in Salem County, or the Mid-Salem County Municipal
Court, shall have jurisdiction to enforce said penalty. The New Jersey
Attorney General, the Township of Mannington, or any other person
may institute the proceeding. When the Township or any other person
other than the Attorney General institutes the proceeding, a recovered
penalty should be remitted by the court to Mannington Township.
Any written or oral provision in any agreement whereby any tenant
waives any rights under this article or N.J.S.A. 46:8-27 et seq. shall
be deemed against public policy and unenforceable.
