(a) 
In addition to the members of the city council, the officers of the city are:
(1) 
The city secretary;
(2) 
The city administrator;
(3) 
The fire marshal;
(4) 
The judge of the municipal court;
(5) 
The chief of police.
(b) 
The salaries of such officers shall be fixed by the city council and may be changed from time to time.

(a) 
Time of appointment.
The city council shall appoint the city officers listed under section 9.02.001 during the first regular meeting in the month of June of each calendar year, or as sooner thereafter as is practicable.
(b) 
Recommendations of city administrator.
The city administrator shall make recommendations to the mayor regarding which individuals should be appointed to each city office listed in section 9.02.001; provided, however, that the city administrator may not make a recommendation regarding the appointment of his or her own office. The mayor has sole authority to make recommendations to the city council regarding the appointment of the office of city administrator. The mayor shall make such recommendations contemporaneously with the recommendations regarding the appointment of all other city officers.
(c) 
Recommendations of mayor.
If the mayor agrees with the city administrator’s recommendations, the mayor shall provide such recommendations in writing to the full city council. If the mayor disagrees with the city administrator’s recommendations regarding the appointment of one or more individuals, the mayor may replace the name of such individuals and replace them with the names of such persons the mayor believes to be duly qualified for the appropriate city office. The city council shall give primary consideration to the individuals recommended by the mayor, but in no case is the city council obligated to accept such recommendations.
(d) 
Term of office; vacancies.
The terms of office of all city officers shall be for one (1) year or until a vacancy occurs through resignation, death, or removal. Vacancies shall be filled by the city council in accordance with the recommendation process described above at the next regular meeting following the occurrence of the vacancy. Such appointments shall be for the unexpired term of that office.

The city council may prescribe individual surety bond requirements for each office conditioned upon the proper and faithful discharge of the duties of such office. In lieu of individual surety bonds, the city council may prescribe a “blanket” surety bond for any number of officers, except that in all cases the tax assessor and collector must be covered by an individual bond. The premiums of all such bonds shall be paid by the city.
