(a) The
zoning board of adjustment may allow signs to vary from the size,
location or construction requirements of this chapter.
(b) An administrative fee as provided in the fee schedule in appendix
A shall be charged to all applicants requesting a variance from this chapter. Nonprofit organizations shall be exempt from the administrative fee when requesting a variance.
(c) If the
applicant or the city is dissatisfied with the decision of the zoning
board of adjustment, acting as the board of appeals, concerning a
variance requested hereunder, the dissatisfied party may appeal such
decision to the city council for final determination. Such appeal
shall be initiated by the appellant presenting a written notice of
appeal to the city secretary, stating the appellant's desire to appeal
and the decision or portion of decision of the zoning board of adjustment
from which the appellant desires to appeal. No additional fee shall
be charged for such an appeal. Upon hearing such appeal, the city
council, by majority vote, may affirm, reverse or modify the decision
of the zoning board of adjustment upon such variance request.

Any sign constructed or which may hereafter be constructed,
pursuant to any variance heretofore authorized, shall be considered
a sign conforming to the provisions of this chapter.
