For the purposes of this article, the following terms, phrases, words, and their derivations shall have the meaning ascribed to them in this section. When not inconsistent with the context, words used in the present tense include the future, words used in the singular number include the plural, and words used in the plural number include the singular. Definitions not expressly prescribed herein are to be determined according to customary usage.
Building.
Any structure which is built for the support, shelter, or enclosure of animals, chattels, machinery, equipment, or movable property of any kind.
Building line or building setback line.
A line generally parallel to the street right-of-way line, and defines an area on the building lot between the street right-of-way line and the building line within which no building or structure shall be permitted.
Building official.
The designated inspection authority of the city.
City council.
The duly and constitutionally elected governing body of the city.
City manager.
The person employed as the chief administrative officer of the city and duly appointed by the city council.
Common access route/internal street.
A private drive allowing the principal means of access to individual manufactured home lots or auxiliary buildings.
Driveway.
A minor entranceway off the common access route within the park, into an off-street parking area serving one or more manufactured homes.
Front or frontage.
That portion of a tract of land that abuts on a public street to which it has direct access.
HUD-code manufactured home.
A structure, constructed on or after June 15, 1976, according to the rules of the United States Department of Housing and Urban Development, transportable in one or more sections, which, when erected on-site, is 320 or more square feet, and which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities, and includes the plumbing, heating, air conditioning, and electrical systems. The term does not include recreational vehicles.
Lot.
A physically undivided tract or parcel of land having frontage on a public street, and which is, or in the future may be, offered for sale, conveyance, transfer, lease, or improvement, which is designated as a distinct and separate tract and which is identified by a lot number or tract symbol on a duly approved subdivision plat which has been properly recorded.
Lot depth.
The length of a straight line connecting the midpoint of the front and rear lot lines.
Lot width.
The length of a line (drawn perpendicular to the lot depth line) connecting the side lot lines at the building setback line or at a point no farther than 35 feet from the front lot line.
Manufactured home.
A HUD-code manufactured home.
Manufactured home park.
Any plot of ground upon which two or more manufactured homes, occupied for dwelling or sleeping purposes, are located, regardless of whether or not a charge is made for accommodation.
May.
Is permissive.
Mobile home.
A structure that was constructed before June 15, 1976, transportable in one or more sections, which, in the traveling mode, is eight (8) body feet or more in width or forty (40) body feet or more in length, or, when erected on-site, is 320 or more square feet, and which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities, and includes the plumbing, heating, air conditioning, and electrical systems.
Modular home.
A home built off-site and brought into the site and must meet or exceed HUD-code manufactured home standards. The term “manufactured home” shall be inclusive of the term “modular home.”
Parking, off-street.
A minimum space ten feet (10') in width by twenty feet (20') in length, located within the boundary of a manufactured home space, or in a common parking and storage area having unobstructed access to an internal street or public roadway.
Permit - HUD-code manufactured home.
A written special use permit or certification issued by the city to determine the appropriate location for a HUD-code manufactured home within the city.
Permit - HUD-code manufactured home park.
A written permit or certification issued by the city permitting the construction, alteration, extension and/or operation of a manufactured home park under the provisions of this article and regulations issued hereunder.
Permit - recreational vehicle park.
A written permit or certification issued by the city permitting the construction, alteration, extension and/or operation of a recreational vehicle park under the provisions of this article and regulations issued hereunder.
Person.
Any natural individual, firm, trust, partnership, association or corporation.
Plot.
A legal description of a piece of land with dimensions indicated on a subdivision plat.
Prefabricated building.
Any building or structure which is built off site, usually consisting of multiple sections, shall not be used as a residence, and may be brought into a site for the support, shelter or enclosure of property or equipment of any kind. It shall not include portable buildings built specifically for storage only.
Recreational vehicle.
A recreational motorized vehicle that is built on a single chassis and designed primarily as temporary living quarters for recreational, camping, travel or seasonal use and is designed to travel under its own power without the need for any additional outside source to push, pull or tow the recreational vehicle. The recreational vehicle is designed to have fixed wheels and axles connected to the frame of the recreational vehicle. For the purpose of definitions, only, the term “recreational vehicle” shall include travel trailer.
Recreational vehicle park.
Any plot of ground upon which two or more recreational vehicles, occupied for dwelling or sleeping purposes, are located, regardless of whether or not a charge is made for accommodation.
Sewer connection.
A connection consisting of pipes, fittings and appurtenances from the drain outlet of a manufactured mobile home [sic], recreational vehicle, or mobile home to the inlet of the corresponding sewer service riser pipe of the sewage system serving the manufactured home park.
Sewer service riser pipe.
That portion of sewer service that extends vertically to the ground elevation and terminates at a manufactured home, recreational vehicle, or mobile home space.
Shall.
Is always mandatory.
Skirting.
Material installed along the sides and ends of a manufactured home to enclose the opening between the bottom of the frame and the ground. Skirting must be a fire resistant material as approved by the city and installed per regulations of the manufactured housing rules of the Texas Department of Housing and Community Affairs.
Space.
A plot of ground within a manufactured home park or a recreational vehicle park designated for accommodation of one manufactured home or a recreational vehicle, together with such open space as required by this article. The term includes “lot” and “site.”
Tie-downs.
The anchoring of a manufactured home to the ground. All tie-downs shall meet or exceed the requirements for manufactured home tie-downs in the Manufactured Housing Standards Act of the state.
Travel trailer.
A structure, having no foundation other than a permanent chassis with wheels, which is twelve (12) body feet or less in width, and is designed to be used as a dwelling with or without a permanent foundation. The term “travel trailer” includes folding hardtop campers transported behind a motor vehicle, truck-mounted campers attached to and transported behind a motor vehicle or pickup, campers, converted buses, tent trailers, or similar devices used for temporary portable housing, or similar types of temporary dwellings intended for short-term occupancy, travel, and/or recreation. For the purpose of definitions, only, the term “travel trailer” shall include recreational vehicle.

Any person, firm or corporation violating this article or any portion thereof shall, upon conviction, be guilty of a misdemeanor and shall be fined not less than ten dollars ($10.00) and no more than five hundred dollars ($500.00), and each day that such violation continues shall be considered a separate offense and punishable accordingly.

Neither the city nor any authorized agent of the city acting under the terms of this article shall be liable or have any liability by reason of orders, permits, or licenses issued or work done under the terms of this article.

This article shall not apply to manufactured home parks, manufactured homes, recreational vehicles, mobile homes, or modular homes which were already located on the property and being occupied for residential purposes on or before September 8, 1998, and the persons occupying such manufactured homes, recreational vehicles, mobile homes, or modular homes shall have the right to continue such occupancy, provided the manufactured home, recreational vehicle, mobile home, or modular home so occupied complies with the sewage, water, gas and electrical requirements of this article. However, the right of such persons to occupy manufactured homes, recreational vehicles, mobile homes, or modular homes without a permit shall not be transferable, nor shall they have the right to move said home to a different location within the city limits, other than its location on September 8, 1998. Any recreational vehicle or mobile home that is removed from the September 8, 1998, location shall no longer be exempt from the requirements of this article.

If a request for a permit is rejected or a permit is revoked, the applicant may file an appeal with the city council by requesting that the city manager place the appeal on the agenda for the next city council meeting. The council shall be furnished with a copy of the investigator’s report and shall hear from both the applicant and staff. The decision of the city council shall be final.

The provisions of the Manufactured Housing Standards Act, Texas Occupations Code, Manufactured Housing, chapter 1201, and any amendments thereto, are adopted by the city together with the regulations promulgated by authority of said act by the state as the same pertain to the manufacture and installation of manufactured housing.

The provisions of this article do not exempt manufactured homes or recreational vehicles from complying with other provisions within the city Code of Ordinances, including but not limited to the International Building Code, the Standard Housing Code, the International Plumbing Code and/or the National Electrical Code.

(a) 
Manufactured homes shall be permitted in districts zoned R-2, R-3, R-4, R-5 and I. Manufactured housing shall be prohibited in districts zoned R-1, B-1 and B-2.
(b) 
The installation of mobile homes constructed before June 15, 1976, for use or occupancy as a residential dwelling in the city is prohibited. This provision is prospective and shall not apply to any mobile home used and occupied as a residential dwelling within the city on the 8th day of June, 1998, until such time a change in occupancy and/or the ownership occurs, at which time a permit will be required. In order to be permitted, the mobile home shall meet all plumbing and electrical code requirements as well as the tie-down and skirting for HUD-code manufactured homes as provided this article.

Manufactured homes or recreational vehicles existing prior to the 8th day of June 1998 within the city and located outside of a manufactured home park shall be considered as nonconforming. The continued use of a conforming or nonconforming manufactured home or recreational vehicle shall be permitted. Replacement of a nonconforming manufactured home or recreational vehicle shall meet all requirements of this article and shall be permitted.

Each manufactured home within the jurisdiction of the city shall have a conspicuously displayed address number which contrasts in color to the background of the portion of the manufactured home where it is displayed. The address numbers shall be placed on the side of the manufactured home which faces the street. The address numbers shall be visible from the street.

This article is not intended to abrogate or annul any permit or license issued or agreement made by the city council prior to the 8th day of June, 1998, with respect to the location of a manufactured home, recreational vehicle, or manufactured home park or the operation of a manufactured home park.

Prefabricated buildings shall be permitted in districts zoned P and I, and shall comply with all regulations of the manufactured housing and recreational vehicle article as a manufactured home.
