Violation of this article is unlawful, and is an offense punishable by a fine not to exceed $500.00. Each day and each violation shall constitute a separate offense.

No person, firm, or corporation shall make, continue, or cause to be made or continued any loud or unnecessary noise which interferes with the normal enjoyment of life or property or disturbs, endangers, or interferes with the public peace and comfort within the city limits.

It shall be a defense to prosecution under this article that the operating or broadcast of voice or music [was] through loudspeakers or amplifiers and that the same were operated at a public event on property owned by the city, municipal subdivisions, the Independent School District, and other authorized event sponsors and advance permission for such operations was obtained from the city by and through its authorized agents, those agents being either/or the mayor, mayor pro tempore, city administrator and city secretary.

The following enumerated acts are declared to be loud, disturbing, and unnecessary noises in violation of this article, but such enumeration shall not be deemed to be exclusive:
(1) 
The playing of any radio, television, musical instrument, phonograph, stereo, tape player, compact disc player, or other machine or device for the producing, reproducing, or amplification of sound in such a manner as to create a noise which could be reasonably considered to disturb a person of ordinary disposition residing in the vicinity or at any time with louder volume than is necessary for convenient hearing for persons who are in the room, vehicle, chamber, or location in which such machine or device is operated and who are voluntary listeners thereto is hereby prohibited. The operation of such set, instrument, phonograph, stereo, tape player, compact disc player, machine or device in such a manner as to be plainly audible at a distance of 50 feet from the building, structure, vehicle, or location in which it is situated shall be prima facie evidence of a violation of this article.
(2) 
The playing or operating or permitting to be played or operated any phonograph, stereo, tape player, compact disc player, or loud-speaking or noise-making device or attachment on any premises under the ownership, management, or control of such person, when such premises are being used as a place of business to which the public generally is invited, in such a manner or in such volume as to be reasonably calculated to disturb the peace or to be unreasonably offensive to the public or the occupants of other premises in the vicinity.
(3) 
The continued and frequent sounding of any horn or signal device on any automobile or other vehicle, except as a danger signal or warning signal to another vehicle.
(4) 
The use of any automobile, motorcycle, or other vehicle so out of repair or operated in such manner as to create loud and unnecessary spinning or squealing of tires, grating, grinding, rattling, or other noise at such a level that would be disturbing to persons of ordinary sensibilities in the area where the vehicle is operated.
(5) 
The unnecessary revving of a vehicle’s engine beyond that required to start the engine.
(6) 
The operation of a motor vehicle with an exhaust system that is in such disrepair or which has been modified so that it creates a loud noise that is reasonably calculated to disturb the peace or which would be reasonably considered to disturb a person of ordinary disposition residing in an area where such vehicle is operated.
(7) 
Frequent, excessive and long-continued barking, howling, cackling, crowing or other noises made by animals and birds kept by a person where such noise would disturb a person of ordinary sensibilities residing in an area adjacent to or in the neighborhood where the animal(s) are kept.
(8) 
The use of loud equipment, hammering, drilling, air compressors, excavating and demolition equipment or other such mechanical activities after 9:00 p.m. and before 7:00 a.m. where such would reasonably be believed to disturb the occupants of neighboring residential premises, and is not required by emergency or urgent need for repair to protect life or property.
(9) 
The creation of any excessive and unreasonable noise on any street adjacent to any school or institution of learning while same is in session, or adjacent to any hospital, which unreasonably interferes with the workings of such institutions, provided conspicuous signs are displayed in such a manner indicating that the same is a school or hospital zone.
(10) 
Raucous shouting and crying of peddlers, hawkers and vendors or the use of drums, loudspeakers, bullhorns or other instrument or device for the purpose of attracting attention, by the creation of noise, to any performance, show or sale of merchandise.
