As used in this article, the following shall mean:
Animals.
Any monkeys, raccoons, opossums, de-scented skunks, rabbits, chinchillas, hamsters, and similar animals of all descriptions regardless of sex, other than livestock, allowed to be kept through the means of an authorized animal permit within the city limits.
Fowl.
Any chickens, turkeys, geese, guineas, ducks, pigeons, pheasants, or similar classified fowl allowed to be kept through the means of an authorized fowl permit within the city limits.
Livestock.
Any horse, mule, jack, jenny, cow, cattle, sheep, goat, hog or similar animal allowed to be kept through the means of an authorized livestock permit within the city limits.
Livestock, fowl and animal permits.
Permits allowed for the keeping of livestock, fowl and animals within the city limits authorized only by the city council, in accordance with the regulations and procedures of this article.
Owner.
Any person, firm or corporation owning, keeping or harboring or having control of livestock, fowl and/or animals as defined in this section.
Wild animal.
Includes any mammal, amphibian, reptile, or fowl which is of a species which is wild by nature, and of a species which, due to size, vicious nature, or other characteristic, is dangerous to human beings. Such animals shall include, but not be limited to, deer, lions, tigers, leopards, panthers, bears, wolves, raccoons, skunks, apes, gorillas, monkeys, foxes, elephants, rhinoceroses, alligators, crocodiles and all forms of poisonous reptiles. The term “wild animal” as used in this code shall not include gerbils, hamsters, guinea pigs, mice or rabbits.

Any person who violates this article or any provision thereof, shall upon conviction, be subject to a fine as provided for in the general penalty provision found in section 1.01.009 of this code, and each and every day such violation shall continue shall be deemed to constitute a separate offense.

It shall be unlawful for any person to violate any of the following regulations and sanitation requirements:
(1) 
To feed, breed, stable, pasture, or keep any cow or cows, goat or goats, horse or horses, sheep or any other livestock of like species in or on any lot, pen, building, parcel of land, stable, or other enclosure in the city, any part of which lots, pen, building, stable, parcel of land or other enclosure, is nearer than one hundred (100) feet to any building occupied by any person any part of the day or night.
(2) 
To feed, breed, corral, cage, or keep any fowl or animals, as defined respectively in this article, on or in any lot, pen, building, parcel of land, stable or other enclosure in the city, any part of which lot, pen, building, stable, parcel of land or other enclosure, nearer than one hundred (100) feet to any building occupied by any person any part of the day or night.
(3) 
An exception will be made to subsections (1) and (2) when the owner and/or resident, that owns a building closer than 100 feet to the place where livestock, fowl and animals are to be placed, signs an affidavit consenting to the placement of the livestock, fowl, and animals.
(4) 
The place of feeding, breeding, stabling, pasturing, or keeping of any such livestock shall be kept free of offensive odors, flies, rodents and other pests.
(5) 
Keep any poultry, fowl or fowls within any structure in the city without scraping the floor of the room, coop, box or compartment and thoroughly cleaning the area within which such fowl or fowls are kept at least once every week and so maintaining such structure or enclosures that no offensive odors are emitted therefrom.
(6) 
Keep any chicken or turkeys within any structure the interior of which is not whitewashed at least once every six months and without spraying crude oil or some disinfectant on the roosting place at least once in each calendar month to discourage insects, fleas, mites and flies.
(7) 
All persons keeping animals within the city shall keep the premises upon which such animals are kept clean and free from noxious and unpleasant odors and shall use some standard spray and/or other chemical control at reasonable intervals so as to keep such premises free from flies, mosquitoes and other vectors.
(8) 
Every keeper of animals shall confine the same in an enclosure sufficient to prevent their running at large and such enclosure shall be maintained in a clean and sanitary condition at all times.

Every keeper of animals, livestock or fowls shall cause the litter and droppings therefrom to be disposed of in a manner approved by the city administrator or his authorized representative.

All feed provided for animals, livestock or fowls shall be stored and kept in a ratproof, flytight building, box, container or receptacle.

(a) 
Veterinary hospitals, clinics and the related practices of veterinary medicine shall be excepted from the provisions of this article.
(b) 
Stock shows, pet fairs, pet shops, humane societies, slaughterhouses, auction pens, rodeo arenas, riding stables, circuses, public zoos, governmental agencies, laboratories, and research facilities approved by the city administrator are excepted from the provisions of this article.

Any owner desiring to keep such livestock, fowl or animals, as herein defined in the corporate limits of the city, shall make application to the city council; such application form to be provided for by the city shall contain the following information:
(1) 
Name of owner and date of application.
(2) 
Description and number of livestock, fowl or animals to be kept.
(3) 
Legal description of property and address where livestock, fowl, or animals will be maintained.

(a) 
The city council shall approve or reject any livestock, fowl, or animal permit as the city council deems to the best interest, health and general welfare of the citizens of the city; no permit shall be issued which is injurious to the health, wellbeing and general welfare of said citizens of the city; nor shall such livestock, fowl or animal permit be issued to any person who permits obnoxious odors, [flies, insects or unclean conditions to exist on the premises where such] livestock, fowl or animals are being kept.
(b) 
The city council shall have the power and authority at any time to revoke and cancel any permit previously issued, provided, however, any person who has had their permit revoked or canceled, shall have the right of appeal to the city council, by filing the appeal with the city council within ten (10) days from the date of mailing of notice of revocation or cancellation to the holder of the permit at the address shown on the application.

The annual permit fee for the keepers of livestock, fowls, or animals as required by this article, shall be as provided for in the fee schedule found in the appendix of this code. The permits will expire on December 31st of each year and are not transferable from person to person.

At least once every six (6) months the city council or their authorized representative shall inspect every area or place for which a permit has been issued for the keeping of livestock, fowl or animals. In case the city council or their authorized representative discovers the violation of any item of sanitation, he shall make a second inspection after a lapse of such time as he deems necessary for the defect to be remedied, and the second inspection shall be used in determining compliance with the requirements of this article. Any violation of the same item of this article on such second inspection shall call for immediate suspension of the permit.

No permit shall be issued to anyone where the following conditions exist:
(1) 
Where there exists the feeding, breeding, stabling, pasturing or keeping of any cow or cows, goat or goats, horse or horses, sheep, hogs, or any other livestock of like species in or on any lot, pen, or building, parcel of land, stable, or other enclosure in the city, any part of which lot, pen, building, stable, parcel of land or other enclosure, is nearer than one hundred (100) feet to any building occupied by any person any part of the day or night.
(2) 
It shall not be a defense if the building occupied by any person or persons any part of the day or night is the sole owner of the lot, pen, building, parcel of land, stable, or enclosure where livestock or animals are kept for the purpose of feeding, breeding, stabling, pasturing, or keeping for any period of time exceeding twelve (12) hours.
