The code enforcement officer is designated as the officer of the town who is responsible for enforcing the following ordinances of the town: building code, plumbing code, electrical code, and zoning ordinance. The code enforcement officer is specifically authorized to:
(1) 
Investigate allegations of violations of these codes;
(2) 
Issue citations for violations of these codes when he observes an offense or reasonably believes that an offense has occurred;
(3) 
Determine that a violation has or may have occurred, but that measures such as a warning letter or notification are more appropriate than the issuance of a citation; or
(4) 
Appear as witness in the prosecution of code violations.

(a) 
The code enforcement officer has the primary responsibility for enforcing the ordinances set forth in section 1.04.061 of this division. He is authorized to investigate possible violations and issue citations upon his own initiative, or upon receiving a complaint from any credible person. If a person witnesses a violation of a municipal ordinance, he may report that violation to the code enforcement officer for investigation. After investigation, the code enforcement officer may, based on his knowledge of the ordinance and personal observation:
(1) 
Determine that no violation has occurred;
(2) 
Determine that a violation has occurred and issue a citation, or instruct a peace officer to issue a citation;
(3) 
Determine that a violation has or may have occurred, but that measures such as a warning letter or notification are more appropriate than the issuance of a citation; or
(4) 
Determine that he cannot independently verify whether a violation has occurred.
(b) 
The code enforcement officer shall notify the person who reported the violation of the outcome of the violation.

(a) 
A person who believes that an ordinance violation has occurred may only file a complaint in municipal court if:
(1) 
The code enforcement officer has had the opportunity to investigate as provided in section 1.04.062 of this division; and
(2) 
The code enforcement officer has determined that he cannot independently verify whether a violation has occurred.
(b) 
If that person wishes to pursue the matter in municipal court, he or she must follow the procedures set forth in exhibit A [to Ordinance 317-93], to be maintained on file in the office of the town secretary.

Exhibit A [to Ordinance 317-93], made a part of this division, is adopted as the town’s municipal court policy for the acceptance of complaints submitted by citizens. The town attorney and all employees of the town shall adhere to this policy.

Persons aggrieved by any decision of the code enforcement officer interpreting the provisions of the zoning ordinance may appeal that decision to the board of adjustment as provided by section 18 [20] of the zoning ordinance of the town.
