Whenever any work is being done contrary to the provisions of
this Ordinance, the building official may order the work stopped by
notice in writing (referred to as a “Stop-work Order”)
served on any persons engaged in the doing or causing such work to
be done. The Stop-work Order shall be posted on the property adjacent
to the activity in question, and any such person shall forthwith stop
work until authorized by the building official to proceed with the
work.

A violation of this Ordinance shall authorize the City administrator
to cancel any permit depending in whole or in part on any approval
under this Ordinance. If a permit is canceled, no further work shall
be done on the project made the subject of the permit until the violation
has been cured and new submittals under this Ordinance, as required
by the City administrator, have been made and approved in accordance
with the provisions of this Ordinance and a new permit has been issued.

A violation of this Ordinance shall authorize the City administrator
to deny any approvals or permits sought by the person violating this
Ordinance.

(a) Any person
who violates any of these regulations for lands within the corporate
boundaries of the City shall be subject to a fine of not more than
two thousand dollars ($2,000.00) per day, with each day constituting
a separate violation, pursuant to the Texas Local Government Code,
Chapter 54, as amended.
(b) Appropriate
civil actions and proceedings may be maintained in law or in equity
to prevent unlawful construction, to recover damages, to impose additional
penalties, to restrain, correct or abate a violation of these regulations,
whether such violation occurs with respect to lands within the corporate
boundaries of the City or within the City’s extraterritorial
jurisdiction. These remedies shall be in addition to the penalties
described above.
Any person violating this Ordinance is subject to suit for injunction
as well as prosecution for criminal violations.
